Purpose

Section 33 of the Public Service of Ontario Act (the "PSOA") provides that Management

Board of Cabinet (MBC) may establish directives that will:

  • create classes of position and determine the duties and qualifications for the positions (s. 33(1)),
  • determine the salary ranges or wage ranges for the positions (s. 33(2)), and
  • determine other remuneration including benefits (s. 33(3))

for public servants appointed by the Public Service Commission.

Under the Public Service Act (PSA), classifications for positions, including qualifications, duties and salaries, were established by Order in Council (OIC) except for salaries for previously established classifications for which salaries were determined through collective bargaining.

The purpose of this directive is to provide for the continuance of:

  • all classifications of positions, including duties and qualifications; and
  • salaries including adjustments to salaries previously established by Order in Council under the Public Service Act

until they are amended or replaced by a further MBC directive.

Application and scope

This directive applies to all public servants appointed under s. 32 of the PSOA:

  • ministry employees, and
  • Commission public body employees.

Requirements

  1. Effective the day section 33 of the PSOA comes into force:
    1. All classifications of positions, including duties and qualifications established by Order in Council under the Public Service Act are continued as classes of position under subsection 33(1) of the PSOA; and
    2. All salaries and salary and wages ranges including but not limited to adjustments to salaries, pay for performance and incentive made in any Order in Council under subsection 29(1)(b) of the Public Service Act, except those made by an Order in Council that was revoked before section 33 of the PSOA comes into force are continued as salary and wage ranges and remuneration under subsections 33(2) and (3) of the PSOA, and these shall remain in force until they are amended or replaced by a Directive of the Management Board of Cabinet.
  2. This directive must be maintained in the Board’s archive of directives (PSOA s. 33(7)).
