During the review of a Land Titles Conversion Qualified to Land Titles Absolute (LTCQ to LT+) Application package, land registration staff are required to check that the surveyor’s signature date on the draft reference plan associated with the Application has the same date as the plan attached to the registered Notice of Application (the ‘Notice plan’).

However, as a reference plan is required to be current as of the date of deposit, there is occasionally a need for the land surveyor to update the Notice plan to reflect an up-to-date search of the adjoining or subject parcels. In addition, the land surveyor may have made minor drafting or typographical corrections to the plan before presenting the plan for deposit.

Some land surveyors perform these types of minor updates or corrections to the draft reference plan and sign the reference plan using the same signature date as it originally appeared on the Notice plan. Other land surveyors change their signature date if they have made any amendments to the Notice plan. Both of these approaches can be accommodated by the land registration system.

If land registration staff find the signature date on the final draft reference plan is different from the date on the Notice plan, they should contact the land surveyor to obtain further information pertaining to the changes to the plan. If the staff member is satisfied with the reason for the amended signature date, they may direct the client to deposit the reference plan.

Note that in accordance with EM2008-02 – Certificate of Surveyor, the date shown next to the signature of the Ontario Land Surveyor on the final draft reference plan must match the date set out in in the first part of the Certificate of Surveyor used in the LTCQ to LT+) Application.
