Introduction
The Land Registration Reform Act, R.S.O. 1990, c. L.4, was amended in 1994 to allow for electronic registration of documents. Since December 2010, electronic registration for land titles documents has been mandatory across the province. Currently, well over 99% of all documents submitted for registration under the Land Titles Act are registered electronically.
Documents registered pursuant to the Construction Lien Act, R.S.O. 1990, c. 30 (collectively, “Construction Lien Documents”), are not exempt from the requirements of mandatory electronic registration, but land registration offices have historically permitted Construction Lien Documents in paper format.
New procedures
Effective October 11, 2016, land registry offices across the province will no longer accept paper format Construction Lien Documents submitted for registration under the Land Titles Act, and all Construction Lien Documents submitted for registration under the Land Titles Act must be submitted electronically, unless the number of properties or parties exceeds systems limits.
