ZONING ORDER - CITY OF TORONTO

Consolidation Period: From January 26, 2024 to the e-Laws currency date.

No amendments.

This Regulation is made in English only.

Definition

1. In this Order,

“zoning by-law” means Zoning By-law 569-2013 of the City of Toronto.

Application

2. This Order applies to lands in the City of Toronto, in the Province of Ontario, being lands outlined in red on a map numbered 343 and filed at the Toronto office of the Ministry of Municipal Affairs and Housing located at 777 Bay Street.

Non-application of s. 114 of the City of Toronto Act, 2006, site plan control area

3. Section 114 of the City of Toronto, 2006 does not apply to the lands described in section 2.

Matters that may be dealt with in agreement

4. Each person who owns all or any part of the lands described in section 2 shall enter into one or more agreements with the City of Toronto dealing with the matters listed in subsection 47 (4.4) of the Act.

Applicable zoning by-law

5. (1) The former Borough of East York Zoning By-law No. 1916 does not apply to the lands described in section 2.

(2) The zoning by-law shall apply to the lands described in section 2, which shall be zoned Employment Industrial Office (EO).

Permitted uses

6. Every use of land and every erection, location or use of any building or structure is prohibited on the lands described in section 2, except for the following uses:

1.  The uses permitted in the Employment Industrial Office (EO) Zone that are set out in the zoning by-law.

2.  Retail store.

3.  Warehouse.

4.  Wholesaling use.

5.  Uses ancillary to the uses set out in paragraphs 2 to 4.

Zoning requirements

7. Despite the zoning requirements set out in chapters 60, 200, 220 and 230, except article 60.40.20 and clauses 60.5.40.10 and 60.5.40.60, of the zoning by-law, the following zoning requirements shall apply:

1.  The total maximum gross floor area is 3,500 square metres.

2.  The maximum building height is 10 metres.

3.  The maximum number of storeys is two.

4.  The minimum building setbacks above established grade for a building or structure are as follows:

i.  1.0 metre from the east lot line (Thorncliffe Park Drive),

ii.  6.0 metres from the south lot line.

5.  No minimum building setback above established grade is required from the north lot line, the west lot line or a lane.

6.  No minimum building setback or minimum building separation is required for any portion of a building or structure below the established grade.

7.  A minimum of 75 parking spaces, including any accessible parking spaces, is required and each parking space must have minimum dimensions of 5.5 metres in length, 2.5 metres in width and 2.0 metres of vertical clearance.

8.  Parking is permitted in any front, rear or side yard and no landscape, buffer or building setback is required.

9.  There is no minimum setback from a lot line for a parking space.

10.  A minimum of one Type “C” loading space with minimum dimensions of 6.0 metres in length, 3.5 metres in width and 3.0 metres of vertical clearance is required.

11.  There are no minimum landscaping requirements.

12.  There are no access requirements for loading spaces and those spaces may be located in any yard.

13.  There are no requirements for the provision of bicycle parking spaces.

Terms of use

8. (1) Every use of land and every erection, location or use of any building or structure shall be in accordance with this Order.

(2) Nothing in this Order prevents the use of any land, building or structure for any use prohibited by this Order if the land, building or structure is lawfully so used on the day this Order comes into force.

(3) Nothing in this Order prevents the reconstruction of any building or structure that is damaged or destroyed by causes beyond the control of the owner if the dimensions of the original building or structure are not increased or its original use is not altered.

(4) Nothing in this Order prevents the strengthening or restoration to a safe condition of any building or structure.

Deemed by-law

9. This Order is deemed for all purposes, except the purposes of section 24 of the Act, to be a by-law passed by the council of the City of Toronto.
