ONTARIO REGULATION 732/94

TRANSPORTING NON-AMBULATORY ANIMALS

This Regulation is made in English only.

1. In this Regulation,

“non-ambulatory” means unable to stand without assistance or to move without being dragged or carried. O. Reg. 732/94, s. 1.

2. Goats, horses for slaughter, sheep, wild swine, domestic swine, ratites, deer, elk and bison that are non-ambulatory are designated as livestock. O. Reg. 732/94, s. 2.

3. Dealers who deal in goats, horses for slaughter, sheep, wild swine, domestic swine, ratites, deer, elk or bison are exempt from section 2 of the Act. O. Reg. 732/94, s. 3.

4. No person shall load, unload or transfer non-ambulatory cattle, goats, horses for slaughter, sheep, wild swine, domestic swine, ratites, deer, elk or bison in a manner that,

(a) drags them in direct contact with the ground; or

(b) pulls them by the head, horns, neck, feet or tail. O. Reg. 732/94, s. 4.

5. No person shall move non-ambulatory cattle, goats, horses for slaughter, sheep, wild swine, domestic swine, ratites, deer, elk or bison unless,

(a) they are accompanied by a certificate for direct transport to slaughter issued by a veterinarian; and

(b) they are physically separated from other animals in the vehicle. O. Reg. 732/94, s. 5.

6. If cattle, goats, horses for slaughter, sheep, wild swine, domestic swine, ratites, deer, elk and bison become non-ambulatory during transport, the operator of the vehicle transporting them shall arrange for them to be examined by a veterinarian licensed under the Veterinarians Act and then transport them to a plant licensed under the Meat Inspection Act (Ontario) or to an establishment registered under the Meat Inspection Act (Canada). O. Reg. 732/94, s. 6.

Note: On June 1, 2005, section 6 is amended by striking out “plant licensed under the Meat Inspection Act (Ontario) or to an establishment registered under the Meat Inspection Act (Canada)” and substituting “slaughter plant within the meaning of Ontario Regulation 31/05 (Meat) made under the Food Safety and Quality Act, 2001 operated by a licensee under that regulation or to a registered establishment within the meaning of the Meat Inspection Act (Canada)”.
