Amending O. Reg. 258/98

(RULES OF THE SMALL CLAIMS COURT)

1. Rule 11.1 of Ontario Regulation 258/98 is amended by adding the following rule:

Effect of dismissal on defendant’s claim

11.1.02 If an action against a defendant who has made a defendant’s claim is dismissed for delay under subrule 11.1.01 (1), the defendant’s claim shall be deemed to be dismissed 60 days after the order under that subrule is served, unless the court orders otherwise during the 60-day period.

Commencement

2. This Regulation comes into force on the later of September 1, 2017 and the day it is filed.
