Amending O. Reg. 206/00

(PROCEDURES, PRACTICES AND STANDARDS OF SERVICE FOR CHILD PROTECTION CASES)

1. (1) The definition of “child” in section 1 of Ontario Regulation 206/00 is revoked.

(2) The definition of “Renewed Youth Supports” in section 1 of the Regulation is revoked and the following substituted:

“Renewed Youth Supports” means the Ministry of Children and Youth Services program described in the Table titled “Renewed Youth Supports” in the document titled “Addendum to Ontario Permanency Funding Policy Guidelines”, dated November 15, 2017 and effective January 1, 2018, available on a website of the Government of Ontario. (“Programme de soutien prolongé aux jeunes”)

2. Clause 5 (1) (b) of the Regulation is amended by striking out “or” at the end of subclause (i), striking out “and” and substituting “or” at the end of subclause (ii) and adding the following subclause:

(iii) has received services under an agreement made under subsection 37.1 (1) of the Act and the agreement will be terminated; and

3. (1) Section 13 of the Regulation is amended by adding the following subsection:

(1.1) A society may provide care and maintenance under subsection 71.1 (1.1) of the Act to a person only if the person and the society have entered into an agreement related to the care and maintenance.

(2) Subsection 13 (3) of the Regulation is amended by striking out “71.1 (1), (2) or (3)” and substituting “71.1 (1), (1.1), (2) or (3)”.

(3) Subsection 13 (4) of the Regulation is amended by striking out “71.1 (1), (2) or (3)” and substituting “71.1 (1), (1.1), (2) or (3)”.

(4) Subsection 13 (5) of the Regulation is revoked and the following substituted:

(5) A society or agency shall not provide care and maintenance under subsection 71.1 (1), (1.1), (2) or (3) of the Act that is financial support if the person to whom care and maintenance is to be provided is receiving basic financial assistance under the Ontario Works Act, 1997 or income support under the Ontario Disability Support Program Act, 1997 but a society may provide care and maintenance under subsection 71.1 (1), (1.1), (2) or (3) of the Act to such a person if the care and maintenance is not financial support.

Commencement

4. This Regulation comes into force on the later of the day subsection 4 (1) of Schedule 2 to the Supporting Children, Youth and Families Act, 2017 comes into force and the day it is filed.
