Amending O. Reg. 282/98

(GENERAL)

1. (1) The definition of “Administrator” in section 8.2 of Ontario Regulation 282/98 is amended by adding “and Forestry” after “Natural Resources” wherever it appears.

(2) The definition of “approved managed forest plan” in section 8.2 of the Regulation is amended by striking out “2006” and substituting “2012”.

(3) The definition of “designated government agent” in section 8.2 of the Regulation is amended by striking out “2006” and substituting “2012”.

2. Subsection 9 (5) of the Regulation is amended by striking out “or section 9.3”.

3. (1) Subsection 9.1 (2) of the Regulation is amended by striking out “For 2008 and subsequent taxation years” at the beginning.

(2) Subsection 9.1 (3) of the Regulation is revoked.

4. Subsection 9.2 (4) of the Regulation is revoked.

5. (1) Subparagraph 3 i of section 9.5 of the Regulation is revoked and the following substituted:

i. To provide an approved forest management plan for the land for a term of 10 years commencing the year after the year in which the application is made, or to provide such portions of the plan as the designated government agent may require, in an application under subsection 9.1 (2), 9.2 (2), 9.3 (2) or 9.4 (2).

(2) Subparagraph 3 iii of section 9.5 of the Regulation is amended by adding “and Forestry” after “Natural Resources”.

6. Subsection 9.6 (2) of the Regulation is revoked.

7. (1) Paragraph 1 of subsection 25 (2) of the Regulation is amended by adding “and Forestry” after “Natural Resources” wherever it appears.

(2) Paragraph 2 of subsection 25 (2) of the Regulation is revoked and the following substituted:

2. The land is identified by the Minister of Natural Resources and Forestry as a provincially significant area of natural and scientific interest using the criteria set out in the Ministry of Natural Resources and Forestry document entitled “Identification and Confirmation Procedure for Areas of Natural and Scientific Interest”, dated April 2011, as it may be amended from time to time, or in the Ministry of Natural Resources and Forestry document entitled “A Framework for the Conservation of Ontario’s Earth Science Features”, dated October 1981 and revised in 2017, as it may be amended from time to time.

(3) Paragraph 3 of subsection 25 (2) of the Regulation is amended by adding “and Forestry” after “Natural Resources” wherever it appears.

(4) Paragraph 4 of subsection 25 (2) of the Regulation is amended by striking out “an escarpment natural area” and substituting “an Escarpment Natural Area”.

(5) Paragraph 1 of subsection 25 (3) of the Regulation is amended by striking out “an escarpment protection area” and substituting “an Escarpment Protection Area”.

(6) Paragraph 2 of subsection 25 (3) of the Regulation amended by adding “as it may be amended from time to time” at the end.

(7) Paragraph 4 of subsection 25 (3) of the Regulation is revoked and the following substituted:

4. It is identified by the Minister of Natural Resources and Forestry as a regionally significant area of natural and scientific interest using the criteria set out in the Ministry of Natural Resources and Forestry document entitled “Identification and Confirmation Procedure for Areas of Natural and Scientific Interest”, dated April 2011, as it may be amended from time to time, or in the Ministry of Natural Resources and Forestry document entitled “A Framework for the Conservation of Ontario’s Earth Science Features”, dated October 1981 and revised in 2017, as it may be amended from time to time.

(8) Paragraph 6 of subsection 25 (3) of the Regulation is amended by adding “and Forestry” after “Natural Resources”.

(9) Paragraph 7 of subsection 25 (3) of the Regulation is amended by striking out “a natural core area, natural linkage area or countryside” and substituting “a Natural Core Area, Natural Linkage Area or Countryside Area”.

(10) Paragraph 11 of subsection 25 (3) of the Regulation is amended by striking out “described in the “Great Lakes Wetlands Conservation Action Plan Highlights Report (2000-2003)”, published by Environment Canada” and substituting “described in the document entitled “Great Lakes Wetlands Conservation Action Plan 2005-2010 Highlights Report”, published by Environment Canada, as it may be amended from time to time”.

8. (1) Paragraph 2 of section 26 of the Regulation is revoked and the following substituted:

2. The owner submits a completed application to the Minister of Natural Resources and Forestry for designation of the land under this section for the taxation year and the application is submitted on or before July 31 of the previous year.

(2) Paragraphs 3 and 4 of section 26 of the Regulation are amended by adding “and Forestry” after “Natural Resources” wherever it appears.

Commencement

9. This Regulation comes into force on the day it is filed.
