(REGISTRATIONS UNDER PART II.2 OF THE ACT - ACTIVITIES REQUIRING ASSESSMENT OF AIR EMISSIONS)
1. Section 6 of Ontario Regulation 1/17 is revoked and the following substituted:
Registration requirement, Environmental Assessment Act undertakings and Part II.3 projects
6. (1) A person who proposes to engage in an activity prescribed by section 2 that forms part of an undertaking or project to which Part II.1 or II.3 of the Environmental Assessment Act applies shall not register the activity in the Registry until,
(a) in the case of an undertaking, if a class environmental assessment approved under Part II.1 of that Act applies with respect to the undertaking and no order has been issued with respect to the proposed undertaking under subsection 16 (1) of that Act, the day all requirements necessary to proceed with the undertaking under the class environmental assessment have been satisfied; or
(b) in the case of a Part II.3 project, the day an approval is given under Part II.3 of that Act to proceed with the undertaking.
(2) In this section,
“Part II.3 project” and “undertaking” have the same meanings as in the Environmental Assessment Act.
Commencement
2. This Regulation comes into force on the later of the day subsection 3 (2) of Schedule 6 to the COVID-19 Economic Recovery Act, 2020 comes into force and the day this Regulation is filed.
