Indian Welfare Services Act

R.S.O. 1990, CHAPTER I.4

Definitions

1. In this Act,

“Indian” means a person who is registered as an Indian or entitled to be registered as an Indian under the Indian Act (Canada); (“Indien”)

“Minister” means the Minister of Community and Social Services. (“ministre”) R.S.O. 1990, c. I.4, s. 1.

Indians eligible for social assistance benefits

2. Every Indian resident in Ontario is entitled to the benefits of the Family Benefits Act or the Ontario Disability Support Program Act, 1997 to the same extent as any other person. 1997, c. 25, Sched. E, s. 4 (1).

Canada-Ontario agreements authorized

3. The Minister, with the approval of the Lieutenant Governor in Council, may make agreements with the Crown in right of Canada, or an agency thereof,

(a) to provide compensation to any children’s aid society that extends its facilities and services to Indians;

(b) to provide compensation to any authority operating a home for the aged that provides accommodation and care for Indians;

Note: On a day to be named by proclamation of the Lieutenant Governor, clause (b) is repealed by the Statutes of Ontario, 2007, chapter 8, section 213 and the following substituted:

(b) to provide compensation to any authority operating a long-term care home approved under Part VIII of the Long-Term Care Homes Act, 2007 that provides accommodation and care for Indians;

(c) respecting the payment of the cost of providing assistance under the General Welfare Assistance Act or assistance under the Ontario Works Act, 1997 for Indians;

(d) respecting the payment of the cost of providing rehabilitation services for Indians; and

(e) respecting the provision and payment of such other services as will promote the well-being of Indians. R.S.O. 1990, c. I.4, s. 3; 1997, c. 25, Sched. E, s. 4 (2).
