Learn how the government can take money or property used for, or resulting from, crime and how to dispute the seizure of your property.

Overview

Administrative forfeiture is when the government takes possession of property or money that was used for, or resulted from, unlawful activity.

This could include:

  • money acquired from the sale of drugs
  • property stolen from businesses
  • personal property such as cash or cars

Under the Civil Remedies Act, the Ministry of the Attorney General has the right to seize these items without a court order, if no interested person disputes it.

We deposit the proceeds from this forfeited property into a special purpose account used to:

  • compensate victims
  • fund grants to support programs that fight crime and assist victims

Anyone filing a dispute will be notified within 45 days if forfeiture proceedings will move forward or be withdrawn.

File a claim to dispute a forfeiture

You can dispute a forfeiture if you receive written notice that your property was seized by the police for use in unlawful activity. Follow the steps below to dispute a forfeiture.

  1. Find your posted notice in the list below. You must submit your dispute form within 120 days from the date the notice was posted.
  2. Call toll-free at 1-888-246-5359 or email CAFP@ontario.ca to get a Notice of Dispute Form.
  3. Submit your completed Notice of Dispute Form to the Ministry of the Attorney General by mail, email or fax.
