About adopting a stepchild or relative

The process for adopting a relative who resides in Ontario, such as a niece, nephew or grandchild, differs from other adoptions in Ontario. You:

  • can complete a relative adoption directly through the court
  • do not require an adoption licensee (licensed adoption agency or licensed individual) to assist you

The process for adopting a relative who resides outside of Canada is different as it must follow the requirements that apply to all international adoptions.

Adopt a relative child who lives in Ontario

To adopt a stepchild or a relative (like a niece, nephew or grandchild) living in Ontario, you can apply directly to an Ontario court for an adoption order. The Ontario court in your area will advise you on how to file an application for a relative adoption. Find an Ontario court.

You may need a lawyer to assist you. The Law Society of Ontario can help you find a lawyer.

You do not need an adoption practitioner to assess you for this type of adoption unless the judge requires it.

Adopt a relative child who lives outside of Canada

To adopt a relative from outside Canada the process is the same as international adoption. Learn about international adoption.

You must:

  • apply through an agency or individual licensed by the ministry to facilitate adoptions in the country where the child is a resident
  • contact an adoption practitioner who will:
  • be approved as a suitable and eligible adoptive parent by the Ministry of Children, Community and Social Services
  • complete the steps necessary to finalize the adoption in the child's country of origin or in Ontario, depending on the country the child is from
  • submit an application to Canadian immigration to get permission for your adopted child to move and reside permanently in Canada
