These particulars are posted following the withdrawal of the appeal of City Truck & Forklift Driving School Ltd. o/a City Truck & Forklift Driving School (“City Truck”) to require a hearing of the Licence Appeal Tribunal under subsection 19 (3) of the Private Career Colleges Act, 2005 (the “Act”).

On February 17, 2022, the Superintendent of Private Career Colleges (the “Superintendent”) issued a Notice of Immediate Suspension and a Notice of Proposal to Revoke Registration to City Truck. On February 28, 2022, City Truck filed a notice to appeal the Notice of Proposal to Revoke Registration with the Licence Appeal Tribunal.

On April 27, 2023, City Truck filed a notice to withdraw its appeal of the Notice of Proposal to Revoke Registration with the Licence Appeal Tribunal. The Superintendent therefore carried out the proposal to revoke the registration of City Truck as a private career college in Ontario on April 27, 2023, pursuant to subsection 18 (2) of the Act.

Reasons for Decision

The Superintendent has suspended and revoked the registration of City Truck for the following reasons:

City Truck breached conditions of its registration, providing grounds to revoke the registration pursuant to subsection 18 (2) (b) of the Act. Specifically,

  • City Truck failed to provide its commercial truck driver (Class A) training programs in a manner consistent with the Superintendent’s condition of program approval for Commercial Truck Driver (Class A) training programs and the Ministry of Transportation’s Commercial Truck Driver (Class A) Training Standard
  • City Truck breached subsection 5 (2) of Ontario Regulation 415/06 (the “Regulation”) made under the Act by using tractor-trailers that were not insured to City Truck to provide its commercial truck driver (Class A) training programs

City Truck failed to comply with provisions of the Act and the Regulation, providing grounds to revoke the registration pursuant to subsection 18 (2) (c) of the Act. Specifically,

  • City Truck failed to comply with subsection 23 (6) of the Act by delivering its commercial truck driver (Class A) training programs at campuses that had not been approved by the Superintendent
  • City Truck failed to comply with subsection 38 (10) of the Act by providing false information to designates of the Superintendent while they were conducting inquiries and examinations at its campus in Cornwall, Ontario
  • City Truck failed to comply with subsection 41 (1) (b) of the Regulation by using unqualified instructors to provide its commercial truck driver (Class A) training programs
  • City Truck failed to comply with subsection 44 (7) of the Regulation by failing to provide receipts to students when they made payments for their commercial truck driver (Class A) training

Furthermore, the Superintendent was no longer satisfied that City Truck met the requirements set out in subsection 14 (1) of the Act, providing grounds to revoke the registration pursuant to subsection 18 (2) (a) of the Act. Specifically,

  • City Truck had been carrying out activities that were in contravention of the Act and the Regulation
  • City Truck’s commercial truck driver (Class A) training programs failed to meet the requirements of the Act and the Regulation
  • The past conduct of director Jagjeet Singh Deol and employee Charanjit Kaur Deol of City Truck failed to provide reasonable grounds for the belief that City Truck would continue to operate in accordance with the law and with integrity and honesty
