Particulars of a Revocation of Registration

S. 49 (1) Ontario Career Colleges Act, 2005 (“Act”)

These particulars are posted following the expiry of the 15-day period for 2224346 Ontario Inc. o/a First Canadian Truck & Forklift Training Centre (“First Canadian/the Business”) to require a hearing of the Licence Appeal Tribunal under s. 19(3) of the Ontario Career Colleges Act, 2005 (“the Act”). On June 10, 2024, the Superintendent issued a Notice of Proposal to Revoke Registration to First Canadian Truck & Forklift Training Centre. First Canadian Truck & Forklift Training Centre did not file a notice to the Licence Appeal Tribunal within the 15-day period. The proposal to revoke First Canadian Truck & Forklift Training Centre’s registration was therefore carried out on June 26, 2024 pursuant to s. 19(4) of the Act.

Reasons for decision

The Superintendent has revoked First Canadian Truck & Forklift Training Centre’s registration for the following reasons:

  1. Ontario Career Colleges Act, 2005, s. 18(2)(a), The Superintendent is no longer satisfied that the Registrant meets all requirements set out in subsection 14 (1) of the Act,
    • The Registrant received forged foreign driver's license records to circumvent the mandatory entry-level training program, presenting a significant risk to students and public safety.
    • The Registrant received students who had obtained forged out-of-country driving experience, thus allowing improperly trained commercial truck drivers to obtain commercial truck drivers' licenses to operate tractor-trailers on Ontario highways, jeopardizing the safety of students and the public and putting Ontario's lives at risk.
    • The Registrant benefitted from the creation and sale of fraudulent records for financial gain. With these documents, the Registrant was able to collect fees from persons to enrol in Class A, MELT training, and obtain employment as a driving instructor.
    • The Registrant provided false and misleading student and instructor documents that obstructed the Designates’ inquiry.
    • The Registrant continues to allow those individuals involved in the creation of forged documents at the campus and perform duties as it relates to an officer or director of the business including. student registration, payments, and training.
  1. Ontario Career Colleges Act, 2005 Subsection (s. )18 (2)(b), Breach a Condition of Registration 

    The Registrant breached a condition of Registration by failing to adhere to the program as approved and in a manner consistent with the MELT training standard and the Superintendent’s Policy Directive:
    • Admission Requirements: The Registrant admitted students to enroll into its approved Class A Truck Training program without having the necessary admission requirements of the program, thereby contravening subsection 19(1) of Regulation 415/06 and breaching a condition of registration.
    • The Registrant failed to implement and maintain lesson plans that meet the Standard's mandatory learning indicators and performance requirements.
    • The Registrant failed to provide backing maneuvers instruction in the manner required by the Standard and as approved and as required by the Superintendent's Policy.
    • The Registrant failed to employ instructors who meet the qualification requirements under the Act, the Superintendent’s Policy Directive, and the Standard, therefore the programs do not meet the requirements of s. 14(1) under the Act.
    • The Registrant failed to maintain training records that accountfor student training hours in each of the training environments in-class, yard, in-cab).
  1. Ontario Career Colleges Act, 2005 Section 18(2)(c), Failed to comply with provisions of the Act or Regulations – Obstruction
    • The Registrant provided the designate with student records that the Registrant knew or ought to have known were false or misleading to a designate while conducting inquiries and examinations into the affairs of the Registrant.
    • The Registrant used false and misleading driver’s license documents in an effort to obstruct the Designates’ inquiry by withholding student and instructor files and providing student and instructor records premised on or containing forged documents.

Superintendent’s action

On June 26, 2024, the Superintendent carried out the proposal to revoke the registration of 2224346 o/a First Canadian Truck & Forklift Training Centre.
