Particulars of a Revocation of Registration

Subsection 49 (1) of the Private Career Colleges Act, 2005 (the “Act”)

May 30, 2023.

These particulars are posted following the expiry of the 15-day period for Exotic Car & Truck Rentals Ltd. o/a Perfect Truck Driving School (Perfect Truck Driving School) to require a hearing of the Licence Appeal Tribunal under s. 19 (3) of the Private Career Colleges Act, 2005 (the “Act”).

On May 12, 2023, the Superintendent of Private Career Colleges (the “Superintendent”) issued a Notice of Proposal to Revoke Registration to Perfect Truck Driving School. Perfect Truck Driving School did not file a notice of appeal to the Licence Appeal Tribunal within the 15-day period. The proposal to revoke the registration of Perfect Truck Driving School was therefore carried out on May 30, 2023, pursuant to s. 19 (4) of the Act.

Reasons for decision

The Superintendent has revoked the registration of Perfect Truck Driving School for the following reasons:

Perfect Truck Driving School has contravened provisions of the Act and Ontario Regulation 415/06 (the “Regulation”) made under the Act, as follows:

  • Act, Subsection 34 (1) – Notice of change
  • Act, Subsection 38 (10) – Inquiries and examinations, Obstruction
  • O.  415/06, Subsections 47 (1) and (2) – Notice re: change of ownership

Perfect Truck Driving School has failed to comply with provisions of the Act and the Regulation, providing grounds to revoke the registration pursuant to subsection 18 (2) (c) of the Act.

The Superintendent is no longer satisfied that Perfect Truck Driving School meets the requirements set out in subsection 14 (1) of the Act, providing grounds to revoke the registration pursuant to subsection 18 (2) (a) of the Act. Specifically:

  • The Superintendent is no longer satisfied that Perfect Truck Driving School can be expected to be financially responsible in the operation of the private career college.
  • The past conduct of Perfect Truck Driving School provides grounds for the belief that the private career college cannot be operated in accordance with the law and with integrity and honesty.
  • Perfect Truck Driving School has been carrying on activities that are in contravention of the Act and the Regulation.

Superintendent’s action

On May 30, 2023, the Superintendent carried out the proposal to revoke the registration of Perfect Truck Driving School.
