Section 19 provides that ss. 82 and 83 of the Employment Standards Act, 2000 apply with respect to director liability under the Employment Protection for Foreign Nationals Act, 2009.

Sections 82 and 83 of the Employment Standards Act, 2000 prohibit contractual and corporate governance provisions purporting to relieve directors from the duty to act in accordance with the Employment Standards Act, 2000 or purporting to relieve directors from liability for breach of the Employment Standards Act, 2000, allow (subject to certain restrictions and conditions) indemnification of directors, and provide that the Employment Standards Act, 2000 does not affect any civil remedies that a director may have against a person or vice versa.
