Order in Council

O.C. 1509/00

On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and concurrence of the Executive Council, orders that:

    1. A person who has commenced an action for damages under the Parental Responsibility Act, 2000 with respect to a child having taken, damaged or destroyed property is entitled to inspect and use, for the purpose specified in subsection (2) and to the extent specified in subsection (3), any record that is kept pursuant to section 40 of the Young Offenders Act (Canada) with respect to the same child and the same incident.
    2. The only purpose for which the person is entitled to inspect and use the record is obtaining evidence to support the action for damages.
    3. The person is allowed to inspect and use only the order of disposition, if any.
    4. The person’s request to inspect and use the record shall be in the form prescribed under Parental Responsibility Act, 2000.
  1. This order is made under paragraph 44.1 (1) (h) of the Young Offenders Act (Canada).
  2. This order comes into effect on the day the Parental Responsibility Act, 2000 is proclaimed in force.
