Applications to Provincial Parliament

Town Of Newmarket

Notice Is Hereby Given that on behalf of The Corporation Of The Town of Newmarket (“Council”), application will be made to the Legislative Assembly of the Province of Ontario, for an Act to enable Council to exercise greater control over the demolition or removal of buildings and structures designated under Part IV, Conservation of Buildings of Historic or Architectural Value, and Part V, Heritage Conservation Districts.

Under the Ontario Heritage Act, Council may currently refuse an application for the demolition or removal of a building or structure for a period of 180 days. If Council refuses that demolition application, the demolition may occur, subject to all applicable legislation, following a delay of 180 days.

This application seeks to enhance the authority by providing that where Council has refused an application for the demolition or removal of a building or structure the building or structure cannot be demolished or removed unless,

  1. the owner has obtained a building permit to erect a new building on the site of the building or structure sought to be demolished or removed and the owner is subject to the requirement that construction of such new building be substantially complete within two years of the commencement of the demolition or removal of the building or structure on the designated property, and
  2. 180 days have elapsed from the date of the decision of Council to refuse the demolition or removal of the building or structure on the designated property.

This application will be considered by the Standing Committee on Regulations and Private Bills. Any person who has an interest in the application and who wishes to make submission, for or against the application, to the Standing Committee on Regulations and Private Bills should notify, in writing, the Clerk of the Legislative Assembly, Legislative Building, Queen’s Park, Toronto, Ontario M7A 1A2.
