Minister’s Order
Under The Business Corporations Act
Pursuant to subsection 271.1(2) of the Business Corporations Act, I, Robert W. Runciman, Minister of Consumer and Commercial Relations, make the following Order:
- The previous Order made pursuant to subsection 271.1(2) of the Business Corporations Act, numbered CB-001 and published in the Ontario Gazette on May 15, 1999, is hereby revoked and replaced by the following:
- The fees set out in the Schedule attached to this Order shall be paid to the Minister of Finance upon the filing, examination or copying of a document or before the Director appointed under the Act takes the action for which the fee is required, as the case may be.
- Where a cheque is tendered in payment of a fee set out in the Schedule, the name of the corporation or the Ontario corporation number in respect of which the cheque is tendered shall be entered on the face of the cheque.
- No fee is payable in respect of a search, document list, profile report or point-in-time report obtained under paragraph 12, 16, 18 or 20 of the Schedule or in respect of certification under paragraph 13, 14, 15, 17, 19 or 21 of the Schedule by,
- any ministry of the government of Ontario or any agency, board or commission thereof, including the offices of sheriff and land registrar;
- a ministry or department of the Government of Canada or of a territory or another province of Canada, or an agency, board or commission of any of them, if the ministry, department, agency, board or commission has entered into a written reciprocal agreement with the Director that provides that fees for specified services provided to the Companies Branch of the Ministry of Consumer and Commercial Relations need not be paid;
- the police department, fire department or any licensing agency of a municipality in Ontario;
- a designated administrative authority which has been designated by the Lieutenant Governor in Council under subsection 3(2) of the Safety and Consumer Statutes Administration Act, 1996 or clause 114(1)(i) of the Electricity Act, 1998; or
- a designated wine authority which has been designated by the Lieutenant Governor in Council under subsection 3(1) of the Vintners Quality Alliance Act, 1999.
- (2) In subsection (1),
- (1) The fee payable for a service set out in the Schedule is the fee set out in the Schedule for expedited service if,
- the person who requests the service requests that it be provided by the end of the business day following the day of the request; and
- the service is provided to the person by the end of the business day following the day of the request.
“business day” means a day during which the Ministry of Consumer and Commercial Relations’ computer system is operational for the purposes of filing and searching under the Act.
- Where a fee has been paid on delivery of articles or an application for an authorization or an order under the Act and the articles or application for an authorization or order are abandoned, refused or withdrawn, the sum of $100 shall be retained and the balance, if any, repaid to the person who paid it or the legal representative of the person.
- This Order comes into force on December 1, 2000.

Rules 53.09(1) and (2)
Calculation Of Awards For Future Pecuniary Damages
The amendment to the discount rate and gross up rate rules, Rules 53.09(1) and (2) of the Rules of Civil Procedure, as amended by section 16 of O. Reg. 288/99 and section 2 of O. Reg. 488/99 respectively, came into force on January 1, 2000.
The Ministry of the Attorney General publishes these rates annually as a public courtesy to facilitate calculation of these awards.
Discount Rates
The discount rates to be used in determining the amount of an award in respect of future pecuniary damages for the 15 year period following the start of the trial and to be applied with respect to actions in which the trial commences after January 1, 2001 is 2.75%.
The rate for any later period covered by the award is 2.50%.
Gross Up Rates
The rate to be assumed for future inflation for the first 15 year period following the start of the trial with respect to actions in which the trial following the start of the trial with respect commences after January 1, 2001 is 3%.
The rate for any later period covered by the award is 3.50%.
