Under And By Virtue of Writs of Seizure and Sale issued out of the Superior Court of Justice of Ontario at Woodstock dated January 10, 2002, Court File Number 222/01, to me directed, against the real and personal property of Randy Donald Price Defendant, at the suit of Julia Marie Hollingsworth and Sunni Angela Hollingsworth by their litigation guardian, Annie Hollingsworth and Annie Hollingsworth personally, Plaintiffs, I have seized and taken in execution all the right, title, interest and equity of redemption of Randy Donald Price, Defendant in and to:

Village of Straffordville, Township of Bayham, being composed of the whole of Lot 9 and the west half of Lot 10 North of First Street, in the said Village of Straffordville according to registered plan No. 205.

As previously described in Instrument 336210.

Save and except for:
Part of Lot 10 on the north side of First Street, Registered Plan 205 described as follows:

Premising that the bearings herein are referred to the north limit of First Street being North 83 degrees 03 minutes 30 seconds West;

Commencing at the south-easterly angle of Lot 10 on the north side of First Street;

Thence North 06 Degrees 23 Minutes 30 seconds east along the easterly limit of said Lot 10 124.7 feet;

Thence North 83 Degrees 03 Minutes 30 Seconds West, 46.73 feet;

Thence South 06 Degrees 23 Minutes 30 Seconds West and parallel to the easterly boundary of said Lot 10 124.74 feet more or less to the northerly limit of First Street;

Thence South 83 Degrees 03 Minutes 30 Seconds East, 46.73 feet to the place of beginning.

As previously described in Instrument 336210.

Two-storey, vinyl sided dwelling with a separate garage.

All of which said right, title, interest and equity of redemption of Randy Donald Price, Defendent, in the said lands and tenements described above, I shall offer for sale by public auction subject to the conditions set out below at, The Court House, 8 Wellington Street, in the City of St. Thomas, in the County of Elgin, on the 10th day of February, 2003 at the hour of 1:00 p.m. in Court Room #2.

Conditions:
The purchaser to assume responsibility for all mortgages, charges, liens, outstanding taxes, and other encumbrances. No representation is made regarding the title of the land or any other matters relating to the interest to be sold. Responsibility for ascertaining these matters rests with the potential purchaser(s).

Terms:

  • Deposit 10% of bid price or $1,000.00, whichever is greater
    • Payable at the time of sale by successful bidder
    • To be applied to purchase price
    • Non-refundable
  • Ten business days from day of sale to arrange financing and pay balance in full at 145 Curtis Street, St. Thomas, Ontario, N5P 3Z7
