Notice Of Intention To Apply For An Order To Close Part Of A Cemetery

The Cemeteries Act (Revised), R.S.O 1990, Chapter C4

Take Notice that the St. John’s Anglican Church Cemetery is located at 212 Church Street in the Village of Bath, Province of Ontario. The cemetery measures approximately 192 metres by 79 metres with an area of approximately 1.5 hectares. The boundaries of the cemetery are shown as Parts 1 and 2, 29R-9597 attached to this Notice. The cemetery also includes the St. John’s Anglican Church, St. John’s Memorial Hall and former St. John’s Church Rectory. There are approximately 350 interments on the cemetery property. The first interments predate 1800. The most recent interment was in 2009.

Take Notice that pursuant to the Cemeteries Act (Revised), R.S.O 1990, Chapter C4, as amended, The Incorporated Synod of the Diocese of Ontario intends to apply for an Order closing that part of the St. John’s Anglican Church Cemetery occupied and used in connection with the former rectory located at 330 Academy Street. The boundaries of the portion of the cemetery to be closed are shown as Part 2, 29R-9597. The reason for the closure application is to permit the former rectory property to be severed and sold.

The Cataraqui Archaeological Research Foundation conducted a Stage 1 and 2 Archaeological Assessment of the portion of the cemetery property to be closed together with the adjacent 9.14 metre wide area. The Archaeological Assessment Report dated June 2009 determined that there were no interments located within the area of the cemetery to be closed.
