Notice of Default in Complying with the Corporations Tax Act

The Director has been notified by the Minister of Finance that the following corporations are in default in complying with the Corporations Tax Act.

Notice Is Hereby Given under subsection 241(1) of the Business Corporations Act, that unless the corporations listed hereunder comply with the requirements of the Corporations Tax Act within 90 days of this notice, orders will be made dissolving the defaulting corporations. The Minister shall exercise the powers and perform the duties, functions and responsibilities that are assigned by law to the Minister or that may otherwise be assigned to or undertaken by the Minister in respect of finance, revenue and any other matters related to the Minister’s portfolio, except as otherwise provided in this Order.
  2. The Minister shall exercise the powers and perform the duties, functions and responsibilities that had previously been assigned and transferred to the Minister under Order in Council O.C. 1568/2011 dated December 7, 2011, as amended, and Order in Council O.C. 1941/2012 dated December 5, 2012, other than those in respect of enterprise-wide capital and operating spending, expenditure management, controllership and internal audit, and such powers, duties, functions and responsibilities are assigned and transferred to the Minister accordingly. The powers and duties that the Minister shall continue to exercise and perform include but are not limited to the powers, duties, functions and responsibilities in respect of the Financial Administration Act, R.S.O 1990, c. F.12 that are referred to in Column B of Appendix A to this Order in Council.
  3. The Minister shall share (with the President of the Treasury Board) the powers, duties, functions and responsibilities in respect of the Financial Administration Act provisions referred to in Column D of Appendix A. Shared powers, duties, functions and responsibilities may be exercised or performed by each minister individually. Alternatively, if both ministers consider it appropriate in particular circumstances, shared powers, duties, functions and responsibilities may be exercised or performed by both ministers jointly.
  4. The Minister shall exercise the powers and duties of the Chair of the Management Board of Cabinet described in subsection 4(2) of the Ontario Lottery and Gaming Corporation Act, 1999 in respect of the approval of the acquisition, holding or disposition of any interest in real property by the Ontario Lottery and Gaming Corporation and such powers, duties, functions and responsibilities are assigned and transferred to the Minister accordingly.

Ministry

  1. The Ministry shall carry out the functions, responsibilities and programs that are assigned by law to the Ministry or that may otherwise be assigned to or undertaken by the Ministry in respect of any matters related to the Minister’s portfolio, other than those in respect of enterprise-wide capital and operational planning, expenditure management, controllership and internal audit (including but not limited to the provision of staff required for the operation and administration of the Treasury Board under subsection 1.0.4(4) of the Financial Administration Act), and such functions, responsibilities and programs are assigned and transferred to the Ministry accordingly.
  2. The Ministry shall share (with the Treasury Board Secretariat) the functions, responsibilities and programs that had previously been carried out by the Ministry of Finance in respect of section 10 and clause 15(b) of the Fiscal Transparency and Accountability Act, 2004, S.O. 2004, c. 27.

Administration of Statutes

  1. Despite any provision of a statute or Order in Council, the administration of the statutes, or parts thereof, set out in Appendix B to this Order in Council is assigned to the Minister. In respect of the Financial Administration Act, the administration of Part III, except clause 38(1)(a.3), and Part V is assigned to the Minister, and the administration of all other sections, except sections 1.0.1 to 1.0.10 and section 1.0.19, is shared between the Minister and the President of the Treasury Board.

Whereas pursuant to subsection 2 (1) of the Executive Council Act, R.S.O 1990, c. E.25, a member of the Executive Council has been appointed under the Great Seal to hold office as the Minister of Government and Consumer Services;

Therefore, Pursuant To subsections 2 (2), 5 (1) and 8 (1) of the Executive Council Act:

Minister to preside over Ministry

  1. The Minister of Government and Consumer Services (the “Minister”) shall preside over a ministry known as the Ministry of Government and Consumer Services (the “Ministry”).

Minister

  1. The Minister shall exercise the powers and perform the duties, functions and responsibilities that are assigned by law to the Minister or that may otherwise be assigned to or undertaken by the Minister in respect of government services, Service Ontario, consumer protection services and any other matters related to the Minister’s portfolio.
  2. The Minister shall exercise the powers and perform the duties, functions and responsibilities that were previously exercised and performed by the Minister of Government Services under Order in Council O.C. 1619/2008 dated September 17, 2008, as amended, in respect of various government services (including human resource services and Ontario shared services) and Service Ontario, and such powers, duties, functions and responsibilities are assigned and transferred to the Minister accordingly. These include but are not limited to the powers, duties, functions and responsibilities of:
    1. the Minister of Consumer and Business Services under the following Acts:

Alternatively, if both ministers consider it appropriate in particular circumstances, shared powers, duties, functions and responsibilities may be exercised or performed by both ministers jointly.
  4. The Minister shall exercise the powers and perform the duties, functions and responsibilities that were previously exercised and performed by the Minister of Consumer Services under Order in Council O.C. 1850/2009 dated November 18, 2009, as amended, in respect of consumer protection services and any other matters related to that portfolio that had been assigned to or undertaken by the Minister of Consumer Services, and such powers, duties, functions and responsibilities are assigned and transferred to the Minister accordingly. On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and concurrence of the Executive Council, orders that:

Order in Council

Whereas pursuant to subsection 2 (1) of the Executive Council Act, R.S.O 1990, c. E.25, a member of the Executive Council has been appointed under the Great Seal to hold office as the President of the Treasury Board;

And Whereas pursuant to subsection 2 (2) of the Executive Council Act, the member so appointed has also been designated as the Minister Responsible for the Poverty Reduction Strategy;

And Whereas the President of the Treasury Board’s responsibilities include overseeing labour relations between the government and the Ontario Public Service and the broader public sector; leading the government’s oversight of Crown agencies, boards and commissions; leading the government towards more accountability, openness and modernization; and helping to ensure that the government stays on a path to fiscal balance that protects vital public services;

Therefore, Pursuant To subsections 2 (2), 5 (1) and 8 (1) of the Executive Council Act:

Minister to preside over Ministry

  1. The President of the Treasury Board (the “Minister”) shall preside over a ministry known as the Treasury Board Secretariat (the “Ministry”).

Minister

  1. The Minister shall exercise the powers and perform the duties, functions and responsibilities that are assigned by law to the Minister or that may otherwise be assigned to or undertaken by the Minister in respect of the Treasury Board, the Management Board of Cabinet and any other matters related to the Minister’s portfolio.
  2. The Minister shall exercise the powers and perform the duties, functions and responsibilities that have been assigned by law to the Chair of the Treasury Board, and such powers, duties, functions and responsibilities are assigned and transferred to the Minister accordingly.
  3. The Minister shall exercise the powers and perform the duties, functions and responsibilities that had previously been assigned and transferred to the Chair of the Management Board of Cabinet under Order in Council O.C. 349/2013 dated March 20, 2013, and such powers, duties, functions and responsibilities are assigned and transferred to the Minister accordingly.
  4. The Minister shall exercise the powers and perform the duties, functions and responsibilities that had previously been assigned and transferred to the Minister of Government Services under Order in Council O.C. 1619/2008 dated September 17, 2008, as amended, in respect of various government services (including information technology services) and any other matters related to that portfolio that had been assigned to or undertaken by the Minister of Government Services (except Service Ontario) that are relevant to the Minister’s portfolio, and such powers, duties, functions and responsibilities are assigned and transferred to the Minister accordingly. These include but are not limited to the powers, duties, functions and responsibilities of the Chair of the Management Board of Cabinet in respect of the following Acts:
    1. Cabinet Ministers’ and Opposition Leaders’ Expenses Review and Accountability Act, 2002, S.O. 2002, c. 34, Sched. A;
    2. Courts of Justice Act, R.S.O 1990, c. C.43; and
    3. Justices of the Peace Act, R.S.O 1990, c. J.4.
  5. The Minister shall share (with the Minister of Government and Consumer Services) the powers, duties, functions and responsibilities that had previously been assigned and transferred to the Minister of Government Services in respect of the Ministry of Government Services Act, R.S.O 1990, c. M.25, insofar as they may be necessary or advisable for the purposes of presiding over the Ministry and otherwise exercising the powers and performing the duties, functions and responsibilities related to the Minister’s portfolio. Shared powers, duties, functions and responsibilities may be exercised or performed by each minister individually. Alternatively, if both ministers consider it appropriate in particular circumstances, shared powers, duties, functions and responsibilities may be exercised or performed by both ministers jointly.
  6. The Minister shall exercise the powers and perform the duties, functions and responsibilities that had previously been assigned and transferred to the Minister of Finance under Order in Council O.C. 1568/2011 dated December 7, 2011, as amended, in respect of enterprise-wide capital and operational planning, expenditure management, controllership and internal audit, and such powers, duties, functions and responsibilities are assigned and transferred to the Minister accordingly. These include but are not limited to the powers, duties, functions and responsibilities in respect of the Financial Administration Act, R.S.O 1990, c. F.12 that are referred to in Column C of Appendix A to this Order in Council.
  7. The Minister shall share (with the Minister of Finance) the powers, duties, functions and responsibilities in respect of the Financial Administration Act that are referred to in Column D of Appendix A. Shared powers, duties, functions and responsibilities may be exercised or performed by each minister individually. Alternatively, if both ministers consider it appropriate in particular circumstances, shared powers, duties, functions and responsibilities may be exercised or performed by both ministers jointly.
  8. The Minister, as the Minister Responsible for the Poverty Reduction Strategy, shall exercise the powers and perform the duties, functions and responsibilities that are assigned by law to the Minister or that may otherwise be assigned to or undertaken by the Minister in respect of the poverty reduction strategy.
  9. The Minister, as the Minister Responsible for the Poverty Reduction Strategy, shall exercise the powers and perform the duties, functions and responsibilities that had previously been assigned and transferred to the Minister of Children and Youth Services under Order in Council O.C. 495/2004 dated March 10, 2004, as amended, in respect of the poverty reduction strategy, and such powers, duties, functions and responsibilities are assigned and transferred to the Minister accordingly.

Ministry

  1. The Ministry shall carry out the functions, responsibilities and programs that are assigned by law to the Ministry or that may otherwise be assigned to or undertaken by the Ministry in respect of the Treasury Board, the Management Board of Cabinet and any other matters related to the Minister’s portfolio.
  2. The Ministry shall carry out the functions, responsibilities and programs that had previously been carried out by the Ministry of Government Services in respect of various government services (including information technology services) and any other matters related to that portfolio that had been assigned to or undertaken by the Ministry of Government Services (except Service Ontario) that are relevant to the Minister’s portfolio, and such functions, responsibilities and programs are assigned and transferred to the Ministry accordingly.
  3. The Ministry shall carry out the functions, responsibilities and programs that had previously been carried out by the Ministry of Finance in respect of enterprise-wide capital and operational planning, expenditure management, controllership and internal audit, and such functions, responsibilities and programs are assigned and transferred to the Ministry accordingly. These include but are not limited to the provision of staff required for the operation and administration of the Treasury Board under subsection 1.0.4 (4) of the Financial Administration Act.
  4. The Ministry shall share (with the Ministry of Finance) the functions, responsibilities and programs that had previously been carried out by the Ministry of Finance in respect of section 10 and clause 15 (b) of the Fiscal Transparency and Accountability Act, 2004, S.O. 2004, c. 27.
  5. The Ministry shall carry out the functions, responsibilities and programs that are assigned by law to the Ministry or that may otherwise be assigned to or undertaken by the Ministry in respect of the Minister’s designation as the Minister Responsible for the Poverty Reduction Strategy.

Administration of Statutes

  1. Despite any provision of a statute or Order in Council, the administration of the statutes set out in Appendix B to this Order in Council is assigned to the Minister. In respect of the Financial Administration Act, the administration of sections 1.0.1 to 1.0.10 is assigned to the Minister, and the administration of all other sections, except section 1.0.19 and Parts III and V, is shared between the Minister and the Minister of Finance.
  2. Despite any provision of a statute or Order in Council, the administration of the statutes set out in Appendix C to this Order in Council is assigned to the Minister, as the Minister Responsible for the Poverty Reduction Strategy.

Whereas pursuant to subsection 2(1) of the Executive Council Act, R.S.O 1990, c. E.25, a member of the Executive Council has been appointed under the Great Seal to hold office as the Minister of Citizenship, Immigration and International Trade;

  1. The Minister of Citizenship, Immigration and International Trade (the “Minister”) shall preside over a ministry known as the Ministry of Citizenship, Immigration and International Trade (the “Ministry”).

The Minister shall exercise the powers and perform the duties, functions and responsibilities that are assigned by law to the Minister or that may otherwise be assigned to or undertaken by the Minister in respect of citizenship, immigration, international trade matters as specified in this Order in Council, and any other matters related to the Minister’s portfolio.

The Minister shall exercise the powers and perform the duties, functions and responsibilities that had been previously assigned and transferred to the Minister of Citizenship and Immigration under Order in Council O.C. 564/2012 dated April 18, 2012, as revised by Order in Council O.C. 833/2014 dated April 30, 2014, and such powers, duties, functions and responsibilities are assigned and transferred to the Minister accordingly, including but not limited to the powers, duties, functions and responsibilities of the Minister under the Ministry of Citizenship and Culture Act, R.S.O 1990, c. M.18, in respect of citizenship and immigration matters.
  3. On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and concurrence of the Executive Council, orders that:

Order in Council

Whereas the Minister of Transportation wishes to further develop Highway 407 East, which includes the design, construction and maintenance of the highway extension of Highway 407 East from Harmony Road through to Highway 35/115 in Clarington including a north-south connector to Highway 401, the East Durham Link (known as the “Project”);

And Whereas the Project is located on lands under the jurisdiction of the Minister of Transportation and relates to matters under the jurisdiction of the Minister of Transportation, including the planning, design, construction, maintenance and operation of a highway, pursuant to the Public Transportation and Highway Improvement Act, R.S.O 1990, c. P.50 (“PTHIA”) and the Minister of Transportation holds exclusive legislative authority over highway lands and the administration of highways under the PTHIA;

And Whereas Ontario Infrastructure and Lands Corporation (“OILC”) was authorized to award a contract for the Project;

And Whereas pursuant to clause 7(4)(j) of the Ministry of Infrastructure Act, 2011, S.O. 2011, c. 9, Sched. 27, the Minister of Economic Development, Employment and Infrastructure provided direction to OILC in respect of the Project;

And Whereas it is recommended by the Ministers of Economic Development, Employment and Infrastructure and Transportation that the agreement to design, build, finance and maintain the Project and ancillary documents and agreements related to the Project (collectively the “Project Documents”) be entered into by Her Majesty the Queen in right of Ontario as represented by the Minister of Economic Development, Employment and Infrastructure as represented by OILC;

And Whereas it is recommended that to enable the Project Documents to be executed, the Minister of Economic Development, Employment and Infrastructure have the authority to share in the powers, duties, functions and responsibilities under the necessary sections of the PTHIA;

And Whereas subsection 8(1) of the Executive Council Act, R.S.O 1990, c. E.25 (“ECA”) provides that the authority of the Lieutenant Governor under that Act includes authority, by Order in Council, to direct that two or more ministers share a power, duty, function or responsibility under an Act;

Now Therefore, pursuant to subsection 8(1) of the Eca, despite any provision of a statute or Order in Council, the Minister of Economic Development, Employment and Infrastructure shall exercise the powers and perform the duties, functions and responsibilities of the Minister of Transportation under the PTHIA for the sole purpose of entering into and implementing the Project Documents.
