Tenders received on or before the due date and time provided in the manner required shall be opened in public on the same day at 3:15 pm local time, at the Village of Sundridge, Council Chambers, 110 Main Street, Sundridge, Ontario, P0A 1Z0

Tenders must be submitted in the prescribed form and must be accompanied by a deposit in the form of a money order or bank draft or cheque certified by a bank, trust corporation or credit union payable to the Corporation of the Village of Sundridge and representing at least twenty per cent (20%) of the tender amount.

The successful purchaser accepts the condition of the land and any improvements thereon in an “as is” condition. The municipality makes no representations or warranties of any kind, either express or implied, as to the condition of the soil, the sub-soil, the ground and surface water or any other environmental matters, the condition of the land or the condition of any structures, if any, or any other matters respecting the land whatsoever.

The successful purchaser will be required to pay the amount tendered and any applicable Harmonized Sales Tax.

The municipality will be hosting two Open Viewings for any potential purchasers.

1st Viewing: Friday, August 7, 2015 from 2:00pm-3:00pm

2nd Viewing: Monday, August 17, 2015 from 10:00am – 11:00am

The sale by the municipality is subject to the following conditions:

  1. Tenders must be submitted in the prescribed form of Tender which can be obtained at the Village of Sundridge municipal office;
  2. No additional terms and conditions may be included in the Tender;
  3. Tenders must be submitted in a sealed envelope which indicates on it that it is a Tender submitted for the purchase of the lands and the envelope must provide a short description or municipal address of the land sufficient to permit the Treasurer to identify that it is a Tender for the land;
  4. On receiving an envelope identified as containing a Tender, the Treasurer of the municipality shall mark on it the time and date on which it was received and shall retain it unopened in a safe place;
  5. Where two or more Tenders are equal, the Tender that was received earlier shall be deemed to be the higher;
  6. Tenders that do not comply with this Notice and the conditions set out herein shall be rejected;
  7. Tenders shall remain irrevocable for a period of 30 days from the date that they are opened in public and Council shall decide whether or not to accept any Tender. The highest Tender or any Tender will not necessarily be accepted.
  8. Once Council of the municipality has decided to accept a Tender the tenderer will be notified by ordinary mail sent to the address shown in the Tender and the tenderer must, within 14 days of the mailing of the notice, pay the balance of the amount tendered plus applicable Harmonized Sales Tax in the form of a money order or of a bank draft or cheque certified by a bank, trust corporation or credit union payable to the municipality.
  9. Upon receipt of monies required by the preceding paragraph (h) the municipality will message and release the Transfer of the land to the lawyer retained by the successful tenderer;
  10. If the tenderer whose Tender is accepted fails to make the payment as set out in Paragraph (h) above the tenderer’s deposit shall be forfeited to the municipality.

Tenders must be submitted in the prescribed form and must be accompanied by a deposit in the form of a money order or of a bank draft or cheque certified by a bank or trust corporation payable to the municipality and representing at least 20 per cent of the tender amount.

Except as follows, the municipality makes no representation regarding the title to or any other matters relating to the land to be sold. Responsibility for ascertaining these matters rests with the potential purchasers.

This sale is governed by the Municipal Act, 2001 and the Municipal Tax Sales Rules made under that Act. The successful purchaser will be required to pay the amount tendered plus accumulated taxes and the relevant land transfer tax.

The municipality has no obligation to provide vacant possession to the successful purchaser.
