Order Made Under the Municipal Act, 2001, S.O. 2001, c.25

Definitions

1. In this Order,

   “annexed areas”

   means the areas comprised of the lands described in Schedules A and B to this Order;

   “City”

   means The Corporation of the City of Brockville;

   “County”

   means The United Counties of Leeds and Grenville; and

   “Township”

   means The Corporation of the Township of Elizabethtown-Kitley.

annexation

2. 1. On January 1, 2019, the areas described in Schedules A and B to this Order are separated from the County and annexed to the City.
   2. All real property of Township and County including any highway, street fixture, water line, sewer main of the annexed areas or easement and restrictive covenant running with the real property located in the annexed areas vests in the City on January 1, 2019.
   3. All assets and liabilities of the Township and County that are located in the annexed areas shall become the assets and liabilities of the City.
   4. Any reserve fund or other account held by the Township or County on January 1, 2019, which is for the sole purpose of maintenance, improvement or operation of any of the assets referred to in subsection (2), shall be transferred to the City on January 1, 2019.
   5. Despite subsection (2), any litigation commenced prior to January 1, 2019, with respect to the annexed areas remains the obligation of the Township or the County, as the case may be.

Assessment

3. For the purpose of the assessment roll to be prepared for the City for taxation in the year that the annexation under section 2 takes effect, the annexed areas shall be deemed to be part of the City and the annexed areas shall be included on the assessment roll for the City.

Compensation

4. 1. On January 30, 2019 the City shall pay:
      1. $623,371.73 to the Township; and
      2. $150,747.24 to the County.
   2. Interest at the rate of 1.25% per month shall be payable by the City to the Township on any amounts under subsection (1) and to the County on the amounts under subsection (2) that are not paid on the dates referred to in subsections (1) and (2), respectively, and interest shall accrue on any outstanding balance from the date the payment was due until the payment is received.

Taxes, ETC

5. 1. All real property taxes, special rates or charges levied under any general or special Act in the annexed areas which are due and unpaid on December 31, 2018, shall be deemed on January 1, 2019 to be taxes due and payable to the City and may be collected by the City.
   2. On or before February 1, 2019, the clerk of the Township shall prepare and furnish to the clerk of the City, in respect of the annexed areas, a special collector’s roll showing all arrears of real property taxes or special rates assessed against the land in the annexed areas up to and including December 31, 2018 and the persons assessed for them.
   3. On or before the first day of the month following the month in which the City has received the special collector’s roll from the Township under subsection (2), the City shall pay to the Township the total amount of any outstanding arrears, inclusive of penalties, accrued to January 1, 2019, in respect of the annexed areas, and thereafter any arrears and penalties collected by the City in respect of the annexed areas shall accrue to the City.
   4. If the Township has commenced tax sales procedures under the Municipal Act, 2001 for land within the annexed areas and the procedures are not completed by January 1, 2019, the City may continue the procedures.

Municipal By-laws

6. 1. On January 1, 2019, the by-laws of the City extend to the annexed areas and shall remain in force in the annexed areas until they expire or are repealed or amended to provide otherwise.
   2. Notwithstanding subsection (1), the by-laws of the Township cease to apply to the annexed areas except for,
      1. by-laws passed under,
         1. section 17, 34, 38, 39 or 41 of the Planning Act or a predecessor of those sections;
         2. the Highway Traffic Act or the Municipal Act, 2001 or a predecessor of those Acts to regulate the use of highways by vehicles and pedestrians and to regulate the encroachment or projection of buildings upon or over highways; and
         3. the Development Charges Act, 1997;

      which shall remain in force until amended or repealed by the City; and

      2. by-laws passed,
         1. under sections 45, 58 or 61 of the Drainage Act or a predecessor of those sections;
         2. under section 10 of the Weed Control Act or a predecessor of that section; and
         3. conferring rights, privileges, franchises, immunities or exemptions that could not have been lawfully repealed by the Township.
   3. The official plan of the Township as it applies to the annexed areas, and as approved under the Planning Act or a predecessor of that Act, becomes an official plan of the City and shall remain in force until revoked or amended to provide otherwise.
   4. The official plan of the County as it applies to the annexed areas, and as approved under the Planning Act or a predecessor of that Act, becomes an official plan of the City and shall remain in force until revoked or amended to provide otherwise.
   5. If the Township has commenced procedures to enact a by-law under any Act or to adopt an official plan or an amendment thereto under the Planning Act and that by-law, official plan or amendment applies to the annexed areas and is not in force on January 1, 2019, the City may continue the procedures to enact the by-law or adopt the official plan or amendment to the extent that it applies to the annexed areas.

Dispute Resolution

7. 1. If a dispute arises with respect to any issue arising out of the interpretation of this Order, any of the municipalities may refer the matter in dispute for resolution through mediation. The mediator shall be agreed upon by both parties.
   2. If the parties cannot agree upon a mediator or the dispute is not resolved through mediation, the matter may be referred to arbitration, to be conducted in accordance with the provisions of the Arbitration Act, 1991, except as provided herein.
   3. Where a dispute is referred to arbitration under subsection (2) the decision of the arbitrator shall be final.
   4. The costs associated with the mediation or arbitration proceedings shall be shared equally between the municipalities.

pursuant to the provisions of sections 197(7), 184(2), 81(13), 82(8), 183(4) and 41(3) of the Mining Act and the authority delegated to me by the Deputy Minister, the following lands that have reverted to the Crown through forfeiture, termination or otherwise shall be open for prospecting, mining claim registration, sale or lease as of 10:00 a.m. eastern standard time on the 1^st day of June, 2018.
