Final Amendments to the Natural Gas Reporting and Record Keeping Requirements (RRR) – Rule for Gas Utilities April 25, 2019

Note: The text of the amendments is set out in italics below, for ease of identification.

  1. Section 1.2 is amended by adding the following definitions (in the proposer place based on alphabetical order):
    “Cyber Security”
    means a body of technologies, processes, and practices designed to protect networks, computers, programs, data and personal information from attack, damage or unauthorized access from both electronic and/or physical sources. Cyber Security includes both electronic and physical security.
    “Cyber Security Program”
    means the utility’s internal Gas Cyber Security Program, which includes a methodology to assess risk, define benchmark objectives and measure cyber security readiness.
  2. Section 1.6 is amended to include information filed under section 2.1.22 among the information the OEB intends to treat as confidential. More particularly, the list of sections set out in section 1.6 is amended as follows:

    2.1.3 (b), 2.1.22, 2.3.1, 2.3.5(a), 2.3.7.2 (a), (c) to (e), 2.3.8, 2.3.9, 2.3.10, 2.3.14 and 2.3.17.

  3. Section 1.8 is amended to add the following paragraph to the end of the section: The amendments to section 1.2 (definitions of “Cyber Security”, and “Cyber Security Program”) and section 1.6, and the new section 2.1.22 of this Rule, made by the Board on April 30, 2019, come into force on April 30, 2019 and are applicable to all filings due on or after that date.
  4. Section 2.1 is amended by adding the following paragraph: 2.1.22 A utility shall provide, in the form and manner required by the Board, annually, by the last day of the fourth month after the financial year-end, the following information for the preceding calendar year with respect to cyber security:
    1. Information on cyber security readiness and actions it is taking relative to its cyber security risks.
    2. A self-certification statement signed by the Chief Executive Officer (CEO) and the Chief Information Security Officer (CISO) on the reported cyber security readiness.

Foreign Cultural Objects Immunity from Seizure Act Determination

Pursuant to delegated authority and in accordance with subsection 1(1) of the Foreign Cultural Objects Immunity from Seizure Act, R.S.O. 1990, c.F-23, the works of art or other objects of cultural significance listed in Schedule “A” attached hereto, which works or objects are to be on temporary exhibit during the In the Age of Rembrandt: Dutch Paintings from the Museum of Fine Arts, Boston exhibition at the Royal Ontario Museum in Toronto, Ontario pursuant to loan agreements between the Royal Ontario Museum and the lender listed in the attached Schedule “A”, are hereby determined to be of cultural significance and the temporary exhibition of these works or objects in Ontario is in the interest of the people of Ontario.

  1. The Solicitor General (the “Minister”) shall preside over a ministry known as the Ministry of the Solicitor General (the “Ministry”).

The Minister shall exercise the powers and perform the duties, functions and responsibilities that are assigned by law to the Minister or that may otherwise be assigned to or undertaken by the Minister in respect of community safety and correctional services and any other matters related to the Minister’s portfolio.
  2. The Minister shall exercise the powers and perform the duties, functions and responsibilities that had been previously assigned to the Minister of Community Safety and Correctional Services under Order in Council O.C. 1145/2018 dated October 22, 2018, and such powers, duties, functions and responsibilities are assigned and transferred accordingly.

The Minister shall exercise the powers and perform the duties, functions and responsibilities that had been previously assigned to the Minister of Correctional Services, including but not limited to the powers, duties, functions and responsibilities of the Minister of Correctional Services under the Ministry of Correctional Services Act in respect of: section 1, Part I, Part II, subsections 34.1(1), sections 35, 36, 36.1, 37, 38, 39, Part IV, Part V.1, section 57.9, subsections 58 (a), (a.1), (b), (d), section 59, and clauses (a), (b), (c.1), (c.2), (c.3), (c.5), (c.6), (c.7), (c.8), (d.1), (e), (f), (g), (h), (i), (l), (l.1), (r), (s), (t), (t.1), (t.2), (u) and (v) of subsection 60(1), and subsections 60 (2), (4) and (5).
