Foreign Cultural Objects Immunity from Seizure Act Determination

Pursuant to delegated authority and in accordance with subsection 1(1) of the Foreign Cultural Objects Immunity from Seizure Act, R.S.O. 1990, c.F-23, the work of art listed in Schedule “A” attached hereto, which work is to be on temporary exhibit during the Haegue Yang: Emergence exhibition at the Art Gallery of Ontario in Toronto, Ontario pursuant to a loan agreement between the Art Gallery of Ontario and the lender listed in the attached Schedule “A”, is hereby determined to be of cultural significance and the temporary exhibition of this work in Ontario is in the interest of the people of Ontario.

Notice of Proposed Regulation

Under s. 74 of the Personal Health Information Protection Act, 2004

Under section 74(6) of the Personal Health Information Protection Act, 2004 (PHIPA), the Minister of Health may decide that the requirements under subsection 74(1) to (5), including notice of the proposed regulation and a 60-day public consultation period, should not apply to the power of the Lieutenant Governor in Council to make a regulation under section 73 of PHIPA. The Minister is required to provide public notice of this decision and the Minister’s reason for making the decision.

I have determined that the proposed regulation is required to clarify the operation of PHIPA and its regulation and is of a minor or technical nature. Therefore, the requirements outlined in subsections 74(1) to (5) of PHIPA should not apply to the power of the Lieutenant Governor in Council to make a regulation under PHIPA respecting the following matter:

Amendments to Ontario Regulation 329/04 (General), O. Reg. 331/11 and O. Reg. 377/19 under PHIPA to remove references to Cancer Care Ontario and eHealth Ontario to reflect the dissolution of the agencies, and that these changes would come into effect immediately after the day that these agencies are dissolved.

I have determined that the sole purpose of the proposed regulation is to reflect that Cancer Care Ontario and eHealth Ontario are dissolved and will no longer be referenced under PHIPA and its regulation. The proposed regulation does not affect business or introduce any new costs or financial burden to stakeholders or the Government.

  1. Section 6.1 of Ontario Regulation 329/04 is revoked.
  2. Section 6.1.1 of the Regulation is amended by striking out “If, pursuant to an order made under subsection 40 (1) of the Connecting Care Act, 2019, Ontario Health assumes the operations, activities and affairs of eHealth Ontario” at the beginning of the portion before clause (a).
  3. Section 6.2 of the Regulation is amended by striking out “eHealth Ontario” wherever it appears and substituting in each case “Ontario Health”.
  4. Section 6.2.1 of the Regulation is revoked.
  5. Paragraph 6 of subsection 13 (1) of the Regulation is revoked.
    1. Paragraph 1 of subsection 18 (1) of the Regulation is revoked.
    2. Subsection 18 (9) of the Regulation is revoked.

Commencement

    1. Subject to subsection (2), this Regulation comes into force on the later of April 1, 2020 and the day it is filed.
    2. Sections 7 and 8 come into force on the day this Regulation is filed.

Order of Minister of Health Pursuant to Subsection 45(2.1) of the Health Insurance Act, R.S.O. 1990, c. H.6

whereas the Minister of Health (the “Minister”) has received the advice of the General Manager, as defined in section 1 of the Health Insurance Act, R.S.O. 1990, c. H.6 (the “Act”);

and whereas the Minister considers it appropriate and in the public interest to do so;

now therefore, pursuant to subsection 45(2.1) of the Act, an Order to amend the schedule of benefits, as defined in section 1 of the Act, is made, as set out in Schedule A herein;

and further, this Order shall be effective from March 21, 2020.

and further, this Order shall remain in force in accordance with subsection 45(2.2) of the Act.
