Order in Council

On the recommendation of the undersigned, the Lieutenant Governor of Ontario, by and with the advice and concurrence of the Executive Council of Ontario, orders that:

O.C. 516/2020

whereas the Transit Oriented Communities (TOC) program proposes that transit station infrastructure will be connected to the structure of a broader development for the Ontario Line located in the City of Toronto, the subway extension known as the Scarborough Subway Extension, and also known as the Line 2 East Extension, located in the City of Toronto, the subway extension known as the Yonge Subway Extension, and also known as the Yonge North Subway Extension, extending from within the City of Toronto to within the Regional Municipality of York, and the light rail transit extension known as the Eglinton Crosstown West Extension extending westward from within the City of Toronto at the station known as Mount Dennis;

and whereas it is recommended that the Minister of Infrastructure have the authority to acquire lands, buildings or structures, or interests in lands, building and structures, expropriate land or interests in land and control, hold, construct and administer, and dispose of Government property, as defined in the Ministry of Infrastructure Act, 2011 (“MOIA”) for TOC purposes;

and whereas pursuant to Order in Council O.C. 1152/2018 the Minister of Government and Consumer Services is responsible for functions, responsibilities and programs, in respect of Government property under the MOIA and under the Ontario Infrastructure and Lands Corporation Act, 2011 (“OILCA”) other than subparagraph 2 ii of subsection 4(1);

and whereas clause 8(1)(g) of the Executive Council Act (“ECA”) provides that the authority of the Lieutenant Governor under that Act includes authority, by Order in Council, to direct that two or more ministers share a power, duty, function or responsibility under an Act;

now therefore, pursuant to clause 8(1)(g) of the ECA, despite any provision of a statute or Order in Council, the Minister of Infrastructure shall exercise the powers and perform the duties, functions and responsibilities of the Minister of Government and Consumer Services under the MOIA and the OILCA related to Government property and the acquisition of land, buildings and structures, or interests in land, buildings and structures and the expropriation of land or interests in land, for the purposes of TOC.
