Subsections 1 and 5 of The Execution Act, R.S.O. 1970, c. 152, as amended by The Execution Amendment Act, 1974, read as follows:-

32.-(1) Where an area of land in a county or provisional judicial district is annexed for judicial purposes to an adjoining county or provision judicial district,

  1. all writs of execution in the hands of the sheriff of the county or provisional judicial district to which the area is annexed at the time of the annexation bind the land in the annexed area from that time, subject to section 153 of The Land Titles Act; and
  2. the annex area shall be deemed to remain in the bailiwick of the sheriff of the county or provisional judicial district of which it was formerly a part in respect of each writ of execution in his hands at the time of the annexation until its withdrawal, expiry or renewal, as the case may be.

(5) Where a regional or district municipality or a county is created, the land therein shall be deemed to be annexed to the regional or district municipal or county for the purposes of this section.

On the 1st day of January, 1973, by virtue of The Regional Municipality of Waterloo Act, 1972, a portion of the Township of Beverly, in the County of Wentworth, was annexed, together with other lands, to the former Village of Ayr to establish an area municipality in The Regional Municipality of Waterloo bearing the name of the Corporation of the Township of North Dumfries.

On the 1st day of January, 1974, by virtue of The Regional Municipality of Peel Act, 1973

On the 1st day of January, 1974, by virtue of The Regional Municipality of Durham Act, 1973, the townships of Mara and Rama, in the County of Ontario, were annexed to the County of Simcoe; the Township of Manvers, in the County of Northumberland, were annexed to the County of Peterborough; and

On the 1st day of January, 1974, by virtue of The Municipality of Metropolitan Toronto Amendment Act, 1973, a portion of the Township of Pickering, in the County of Ontario, was annexed to the Borough of Scarborough, in The Municipality of Metropolitan Toronto.

Six years and more have elapsed since the above-mentioned annexations occurred and persons searching for executions that bind lands in the above-mentioned annexed areas are reminded that it is not necessary to search in the office of the sheriff in whose bailiwick the lands were located immediately prior to such an annexation.

Addition to Bulletin 79059, January 22, 1980

On the 1st day of January, 1974, by virtue of The Regional Municipality of Durham Act, 1973, the Town of Bowmansville, the Village of Newcastle, and the townships of Clarke and Darlington, all in the County of Durham, were amalgamated to establish an area municipality in The Regional Municipality of Durham bearing the name of the Corporation of the Town of Newcastle.

On the 1st day of January, 1974, by virtue of The Regional Municipality of Durham Act, 1973, the Township of Cartwright in the County of Durham was amalgamated with certain other municipalities in the County of Ontario too establish an area municipality in The Regional Municipality of Durham bearing the name of the Corporation of the Township of Scugog.

Six years having elapsed since The Regional Municipality of Durham was created, persons searching for executions that bind lands in the above-mentioned area municipalities are reminded that it is no longer necessary to search in the office of the Sheriff at Cobourg.
