Section 115 of the Land Titles Act and section 22(6) of the Registry Act are not to be construed in future as prohibiting the registration of general assignments of rents. A general assignment of rents is the assignment by the lessor to his creditor of rents under unspecified leases, which may or may not be in existence and which may or may not be registered.

The said sections do, however, prohibit the registration of an instrument which attempts to assign rents under specified leases unless the leases themselves have been registered.

A general assignment of rents in the land titles system should be registered as a notice under section 78 of the Land Titles Act.
