Item 21(b) of the Schedule to Regulation 895 made under the Registry Act provides that in computing the number of instruments when certifying or recertifying a Registrar’s Abstract, an instrument to which section 62 of the Cat applies shall not be included. In addition, when computing fees under this item, Land registrars should not count any instrument to which subsection 51(8), 51(11) or 51(12) of the Act applies.

Subsection 2(2) of Regulation 551 (Land Titles Act) and 895 (Registry Act) provide that the fee for registration or deposit of any instrument or plan includes the endorsement of one duplicate. This subsection is to be interpreted as applying only to duplicates presented at the time of registration.
