Ontario Regulations 233/85 to 240/85, published in the Ontario Gazette on June 1st, 1985 are reproduced below.

Fee Tariff

Ontario Regulation 233/85 amends item 7 of the Schedule to Regulation 551, R.R.O. 1980 made under the Land Titles Act by deleting subitems (d) and (g) and adding subitems (ha) to (he) which provide a registration fee of $6.00 for various instruments under the Municipal Tax Sales Act, 1984.

Ontario Regulation 235/85 amends item 5 of the Schedule to Regulation 895, R.R.O. 1980 under the Registry Act by deleting subitems (f) and (i) and adding subitems (ja) to (je) which similarly provide a registration fee of $6.00 for such instruments, under the Municipal Tax Sales Act, 1984.

Stamps and Forms

Ontario Regulation 236/85 amends section 31a of Regulation 895, R.R.O. 1980 made under the Registry Act so that the requirement for the stamp of the Ministry of Natural Resources indicating whether surface and mineral rights or surface rights only are affected now applies to a tax deed, notice of vesting or notice of forfeiture under the Municipal Tax Sales Act, 1984. In addition, forms 19 and 21 are amended so that they now refer to a Judge of the District Court of Ontario, as a result of the passage of the Courts of Justice Act, 1984.

Ontario Regulation 234/85 similarly amends section 25a of Ontario Regulation 75/82 made under the Land Titles Act so that the requirement for the stamp of the Ministry of Natural Resources now applies to the a tax deed, notice of vesting or notice of forfeiture under the Municipal Tax Sales Act, 1984.

Subdivision Agreements

Ontario Regulation 238/85 amends section 14 of Ontario Regulation 78/82 made under the Land Titles Act by adding a new subsection (5) so that any person who is a party to a subdivision agreement of which notice has been registered under section 74 of the Land Titles Act, may apply to the Land registrar for its deletion or to register a notice of compliance therewith.

Extended Business Hours

Ontario Regulation 239/85 amends subsection 52(2) of Ontario Regulation 75/82 made under the Land Titles Act to permit the “land titles offices” at Whitby, Brampton, Newmarket and Toronto to remain open for business until 5:30 p.m. on May 31, June 28, August 2 and August 30, 1985.

Ontario Regulation 240/85 amends subsection 4(2) of Regulation 896, R.R.O. 1980 made under the Registry Act to permit the “registry offices” at Whitby, Brampton and Newmarket to remain open for business until 5:30 p.m. on the same day as above.

Condominium Descriptions

Ontario Regulation 237/85 amends subsection 12(2) of Regulation 122, R.R.O. 1980 made under the Condominium Act to dispense with the necessity of approval or exemption by the Ministry of Municipal Affairs and Housing where a condominium description is amended by a Judge under subsection 3(8) of the Condominium Act.
