Land registrars are advised as follows:-

  1. The “ex officio” authority of a land registrar in the registry system, to act as a commission for taking affidavits, under subsection 27(1) of the Registry Act can be delegated by a land registrar to an assistant deputy land registrar under subsection 8(5) of the Registry Act. In the land titles system, the administering of oaths may be delegated by the land registrar to an assistant deputy land registrar pursuant to subsection 5(5) or section 22 of the Land Titles Act.
  2. A Deputy Land Registrar in the land titles system has, by virtue of section 22 of the Land Titles Act, authority to administer an oath for any of the purposes of that Act.
  3. Section 9 of the Land Transfer Tax provides that a person authorized to administer an oath under the Land Titles Act or the Registry Act may administer an oath for any of the purposes of the Land Transfer Tax Act.
