Memo to:

Land Registrars

From:

Kate Murray
Director of Titles – Real Property Registration Branch

Contents of the memo:

My memo on December 6th, 1994 concerning the above companies outlined what was required for registering documents concerning these companies.

We have recently had discussions with representatives of the liquidators and have agreed to amend these registration requirements.

The instructions contained in the December memo remain the same except that once the orders are registered in the Land Registry Office with the required affidavit, a document signed after January 17, 1995 by the liquidator in the appropriate manner need only contain a statement that the court order is still in full force and effect and has not been stayed. We will no longer require that the solicitor provide an affidavit for each document registered.

The solicitors for the liquidators have provided me with the appropriate documentation to meet the requirements set out in my December 6th memo. Therefore, for documents executed prior to January 17, 1995, neither an affidavit of the solicitor nor a statement by the Liquidator is required.

If you have any questions, please contact Charles Finley, Arvind Damley or me.
