Memo to:

All Land Registrars
Regional Surveyors

From:

Kate Murray
Director of Titles

Contents of the memo:

As of January 1, 1998, several jurisdictions restructured their municipalities which resulted in a new name for that municipality e.g. the Municipality of Metropolitan Toronto changed its name to the City of Toronto, the County of Kent amalgamated all its municipalities and is now known as the Municipality of Chatham-Kent.

The Ministry of Attorney General has advised the Law Society of Upper Canada of minor changes that should be implemented when commissioning or notarizing affidavits. The current rubber stamps which are used remain valid notwithstanding they may have the former name; however, the new name should be added in writing below the imprint of the stamp. For example, in the cases above, for the former Municipality of Metropolitan Toronto, the words "Now in the City of Toronto" should be added, and for the former County of Kent, the words "Now in the Municipality of Chatham-Kent" should be added.

Therefore, clients should be encouraged to include this amendment; however, its omission is not a reason for rejecting a document for registration.
