One of the amendments which resulted from the Red Tape Reduction Act, 1998 was the provision in the Registry Act to accept notarial copies for most material which generally supports the registration of a document e.g. the provisions under section 105.

The Land Titles Act does not have a similar provision. The requirements for this type of material are provided for in the regulations and prescribed forms and currently the requirement is for original documentation. The mandate given to ministries by the Red Tape Commission was to review the legislation. As a follow up to this, the regulations must be reviewed and amended accordingly. To date this has not yet been accomplished.

This has been discussed with several land registry offices and they have been advised that where the Registry Act was amended to provide that a notarial copy of a document can be accepted, the same concept should apply in land titles. Therefore, until the regulations have been amended, you should accept notarial copies of these documents in both systems of your offices.
