Delegation of regulation-making authority

1. (1) Subject to subsections (2) and (3), the authority to make regulations relating to the matters described in paragraphs 2, 3, 4, 6, 7, 8, 9, 10, 11, 13, 14, 17, 18, 19, 20, 23.1, 24 and 30 of subsection 51 (1) of the Act is delegated to the Minister.  O. Reg. 568/05, s. 1 (1); O. Reg. 258/22, s. 1 (1).

Note: On December 1, 2023, the day subsection 32 (5) of the Trust in Real Estate Services Act, 2020 comes into force, subsection 1 (1) of the Regulation is amended by striking out “13, 14” and substituting “14”. (See: O. Reg. 258/22, s. 1 (2))

(2) The authority to make regulations under paragraph 2 of subsection 51 (1) of the Act that prescribe conditions of registration is not delegated to the Minister.  O. Reg. 568/05, s. 1 (2).

(3) The Minister’s authority to make regulations respecting transitional matters under paragraph 24 of subsection 51 (1) of the Act is limited to those matters which are delegated to the Minister. O. Reg. 258/22, s. 1 (3).
