ONTARIO REGULATION 58/17

VEGETABLES FOR PROCESSING - APPOINTMENT OF TRUSTEE

Consolidation Period: From March 3, 2017 to the e-Laws currency date.

This Regulation is made in English only.

Application

1. This Regulation applies with respect to the local board known as the Ontario Processing Vegetable Growers.

Board and committee members - termination

2. Despite Regulation 441 of the Revised Regulations of Ontario, 1990 (Vegetables for Processing - Plan) made under the Act,

(a) the terms of office of the members of the local board holding office immediately before this Regulation comes into force are terminated; and

(b) the terms of office of the members of each District Vegetable Growers’ Committee holding office immediately before this Regulation comes into force are terminated.

Appointment of trustee

3. (1) Elmer Buchanan is appointed as the trustee of the local board until the first meeting of the local board that is constituted in 2017 in accordance with sections 10 and 11 of the Schedule to Regulation 441 (Vegetables for Processing - Plan) made under the Act.

(2) The trustee may carry out all of the powers of the local board, including, without limitation, the powers of the local board with respect to negotiating agencies under Regulation 440 of the Revised Regulations of Ontario, 1990 (Vegetables for Processing - Marketing) made under the Act.

(3) The trustee is deemed to be an officer of the local board for all purposes, including, without limitation, for the purposes of subsection 3 (6) of the Act and section 22 of Regulation 400 of the Revised Regulations of Ontario, 1990 (By-laws for Local Boards) made under the Act.
