ONTARIO REGULATION 610/20

ZONING ORDER — TOWN OF WHITCHURCH-STOUFFVILLE, REGIONAL MUNICIPALITY OF YORK

Consolidation Period: From October 30, 2020 to the e-Laws currency date.

No amendments.

This Regulation is made in English only.

Definition

1. In this Order,

“zoning by-law” means Comprehensive Zoning By-law 2010-001-ZO of the Town of Whitchurch-Stouffville.

Application

2. This Order applies to lands in the Town of Whitchurch-Stouffville in the Regional Municipality of York, in the Province of Ontario, being the lands outlined in red on a map numbered 248 and filed at the Toronto office of the Ministry of Municipal Affairs and Housing located at 777 Bay Street.

Permitted uses

3. (1) Every use of land and every erection, location or use of any building or structure is prohibited on the lands described in section 2, except for the uses set out in Column 2 of the Table in the areas set out opposite the use in Column 1.

1. The uses identified in sections 5A.1 and 6.1 of the zoning by-law in the Residential New Five (RN5) Zone and the Commercial Residential Mixed-Western Approach (CM2) Zone.

“RN3/RN4/CL”

1. The uses identified in sections 5A.1 and 6.1 of the zoning by-law in the Residential New Three (RN3) Zone, Residential New Four (RN4) Zone and Local Commercial (CL) Zone.

2. Schools.

3. Clubs within the meaning of the zoning by-law.

4. Dry cleaning establishments.

5. Libraries.

6. Service establishments.

7. Veterinary clinics.

“ENV”

The uses identified in section 4 of the zoning by-law in the Environmental (ENV — Outside Oak Ridges Moraine Area) Zone.

“FH”

The uses identified in section 4 of the zoning by-law in the Flood Hazard (FH) Zone.

6.

“OS”

The uses identified in section 8 of the zoning by-law in the Open Space (OS) Zone.

(2) Despite subsection (1), the following uses are permitted on the lands described in section 2:

1. Stormwater management facility.

2. Flood and erosion control.

Zoning requirements

4. The zoning requirements for the lands described in section 2 are as follows:

1. For the uses, buildings and structures permitted under item 1 of the Table to subsection 3 (1), the requirements are the applicable requirements in the RN3 or RN4 Zone in section 5A.2 of the zoning by-law. However, in an area where the RN4 requirements apply, the maximum density is 80 units per net hectare.

2. For the uses, buildings and structures permitted under item 2 of the Table to subsection 3 (1), the requirements are the applicable requirements in the RN5 Zone in section 5A.2 of the zoning by-law or the applicable requirements in the CM2 Zone in section 6.2 of the zoning by-law, with the following exceptions:

i. In an area where the requirements in the RN5 Zone apply, the minimum exterior side yard for apartment buildings is 4.5 metres.

ii. The minimum density is 80 units per net hectare and the maximum density is 140 units per net hectare.

iii. The maximum building height is 10 storeys.

3. For the uses, buildings and structures permitted under item 3 of the Table to subsection 3 (1), the requirements are the applicable requirements in the RN3 or RN4 Zone in section 5A.2 of the zoning by-law or the applicable requirements in the CL Zone in section 6.2 of the zoning by-law.

4. A minimum of 10 and a maximum of 20 per cent of the total lands shown as “RN3/RN4/CL” on the map described in section 2 shall be used for the following uses:

i. The uses set out in section 6.1 of the zoning by-law for the CL Zone.

ii. The uses, buildings and structures permitted in paragraphs 2, 3, 4, 5, 6 and 7 under item 3 of the Table to subsection 3 (1).

5. A minimum of 30 and a maximum of 40 per cent of the area of the total lands shown as “RN3/RN4” and “RN3/RN4/CL” on the map described in section 2 shall be used for single detached and semi-detached dwellings.

6. There is no maximum lot coverage for the lands described in section 2.

7. All buildings with a height of 10 metres or greater shall be built within the angular plane as defined in the zoning by-law.

Terms of use

5. (1) Every use of land and every erection, location or use of any building or structure shall be in accordance with this Order.

(2) Nothing in this Order prevents the use of any land, building or structure for any use prohibited by this Order if the land, building or structure is lawfully so used on the day this Order comes into force.

(3) Nothing in this Order prevents the reconstruction of any building or structure that is damaged or destroyed by causes beyond the control of the owner if the dimensions of the original building or structure are not increased or its original use altered.

(4) Nothing in this Order prevents the strengthening or restoration to a safe condition of any building or structure.

Deemed by-law

6. This Order is deemed for all purposes, except the purposes of section 24 of the Act, to be and to always have been a by-law passed by the council of the Town of Whitchurch-Stouffville.
