Limitation period for certain payments, adjustments and amounts

1. (1) For the purposes of subsection 1.3 (2.1) of the Act, the limitation period applicable to a specified consumer or a regulated rate consumer in respect of an entitlement to a payment, adjustment or amount described in that subsection is two years from the date of issuance of the invoice in which the payment, adjustment or amount was not provided.

(2) Subsection (1) does not limit an entitlement of a specified consumer or regulated rate consumer to a payment, adjustment or amount described in that subsection if the consumer submitted a claim for the payment, adjustment or amount before the day on which this section comes into force.

Note: On July 1, 2023, section 1 of the Regulation is amended by adding the following subsection: (See: O. Reg. 159/23, s. 1)

(3) In the event of a conflict between a limitation period referred to in subsection (1) and a limitation period provided for in section 36.1.1 of the Electricity Act, 1998, the limitation period that provides the longest time period for a claim to be made prevails. O. Reg. 159/23, s. 1.
