ZONING ORDER - CITY OF TORONTO

Consolidation Period: From January 26, 2024 to the e-Laws currency date.

No amendments.

This Regulation is made in English only.

Definitions

1. In this Order,

“height” means the vertical distance between the Canadian Geodetic Datum elevation of 103 metres for Hospital Zone 1 and Hospital Zone 3 and the highest point of a building or structure being measured;

“parking garage” means a building or a portion of a building, other than a private garage, that is used for the temporary parking of motor vehicles, as an accessory use to the principal use or uses permitted on the whole of the lot or on the portion of the lot on which the parking garage is located, and in the case where a parking garage or a portion thereof is accessory to a non-residential use, the parking garage may be occupied by motor vehicles whose users are not occupants or customers of the building where the parking garage is located;

“zoning by-law” means Zoning By-laws 438-86, 831-80, 912-2009 and 569-2013 of the City of Toronto.

Application

2. This Order applies to lands in the City of Toronto, in the Province of Ontario, being the lands outlined in red on the map numbered 309 and filed at the Toronto office of the Ministry of Municipal Affairs and Housing located at 777 Bay Street.

Hospital Zone 1

3. (1) Every use of land and every erection, location or use of any building or structure is prohibited on the lands located in the area shown as “Hospital Zone 1” on the map referred to in section 2, with the following exceptions:

1.  The uses permitted in the zoning by-law.

2.  A parking garage.

3.  The following accessory uses:

i.  branches of a bank or financial institution,

ii.  medical or dental offices,

iii.  offices,

iv.  personal grooming establishments,

v.  restaurants,

vi.  retail stores, and

vii.  take-out restaurants.

(2) The zoning requirements for the uses permitted under subsection (1) are the zoning requirements set out in the zoning by-law, with the following exceptions:

1.  The maximum building height is 84 metres, exclusive of any mechanical equipment, stair towers, elevator shafts, communication equipment, window washing equipment, roof-top chimney stacks, vents and air intakes, and generators or other power, heating, cooling or ventilating equipment on the roof of any building.

2.  Projections are permitted above the maximum building height for any mechanical equipment, stair towers, elevator shafts, communication equipment, window washing equipment, roof-top chimney stacks, vents and air intakes, and generators or other power, heating, cooling or ventilating equipment on the roof of any building.

3.  The maximum non-residential gross floor area is 28,000 square metres.

4.  There is no minimum setback for a building or structure from a lot line adjacent to a street.

5.  There is no minimum setback for a building or structure from the south boundary of Hospital Zone 1.

6.  There is no minimum setback for a building or structure from the east boundary of Hospital Zone 1.

7.  There is no minimum or maximum number of parking spaces required, and parking spaces may be provided off-site within 300 metres of the lands described in section 2.

8.  There is no minimum number of loading spaces required, and loading spaces may be provided off-site of the lands described in section 2.

9.  A minimum of 18 short-term bicycle parking spaces shall be provided.

10.  A minimum of 4 long-term bicycle parking spaces shall be provided.

Hospital Zone 2

4. (1) Every use of land and every erection, location or use of any building or structure is prohibited on the lands located in the area shown as “Hospital Zone 2” on the map referred to in section 2 except for,

(a)  the uses permitted in the zoning by-law; and

(b)  parking, bicycle parking and loading spaces associated with the uses permitted on the lot.

(2) The zoning requirements for the uses permitted under subsection (1) are the zoning requirements set out in the zoning by-law, with the following exceptions:

1.  The maximum non-residential gross floor area is 110,890 square metres.

2.  There is no minimum setback for a building or structure from the boundaries of Hospital Zone 1 and Hospital Zone 3.

Hospital Zone 3

5. (1) Every use of land and every erection, location or use of any building or structure is prohibited on the lands located in the area shown as “Hospital Zone 3” on the map referred to in section 2 except for,

(a)  the uses permitted in the zoning by-law;

(b)  a hospital;

(c)  a parking garage;

(d)  a power generation facility;

(e)  an energy conversion, capture, generation and distribution facility; and

(f)  the following accessory uses:

i.  laboratories,

ii.  energy research and development facilities,

iii.  offices,

iv.  uses related to showcasing technology, and

v.  educational uses.

(2) The zoning requirements for the uses permitted under subsection (1) are the zoning requirements set out in the zoning by-law with the following exceptions:

1.  The maximum building height is 19 metres, exclusive of any mechanical equipment, stair towers, elevator shafts, communication equipment, window washing equipment, roof-top chimney stacks, vents and air intakes, and generators or other power, heating, cooling or ventilating equipment on the roof of any building.

2.  Projections are permitted above the maximum building height for any mechanical equipment, stair towers, elevator shafts, communication equipment, window washing equipment, roof-top chimney stacks, vents and air intakes, and generators or other power, heating, cooling or ventilating equipment on the roof of any building.

3.  The maximum non-residential gross floor area is 4,000 square metres.

4.  There is no minimum first storey height for any building.

5.  There is no minimum setback for a building or structure from a lot line abutting a street or lane.

6.  There is no minimum setback for a building or structure from the east boundary of Hospital Zone 3.

7.  There is no minimum setback for a building or structure from the north boundary of Hospital Zone 3.

8.  There is no minimum distance between main walls of buildings.

9.  There is no minimum or maximum number of parking spaces required, and parking spaces may be provided off-site within 300 metres of the lands described in section 2.

10.  There is no minimum number of loading spaces required, and loading spaces may be provided off-site of the lands described in section 2.

Terms of use

6. (1) Every use of land and every erection, location and use of any building or structure shall be in accordance with this Order.

(2) Nothing in this Order prevents the use of any land, building or structure for any use prohibited by this Order if the land, building or structure is lawfully so used on the day this Order comes into force.

(3) Nothing in this Order prevents the reconstruction of any building or structure that is damaged or destroyed by causes beyond the control of the owner if the dimensions of the original building or structure are not increased and its original use is not altered.

(4) Nothing in this Order prevents the strengthening or restoration to a safe condition of any building or structure.

Deemed by-law

7. This Order is deemed for all purposes, except the purposes of section 24 of the Act, to be a by-law passed by the council of the City of Toronto.

8. Omitted (provides for coming into force of provisions of this Regulation).
