This is the English version of a bilingual regulation.

1. In this Regulation,

“non-electronic format” means a format that is not an electronic format within the meaning of section 17 of the Act.  O. Reg. 17/99, s. 2.

(0.1) Subsections (1) to (5) apply to a document that is required to be in written form when it is submitted for registration under the Registry Act or the Land Titles Act or for deposit under Part II of the Registry Act. O. Reg. 560/20, s. 2 (1).

2. (1) A transfer submitted for registration under the Registry Act or for registration in a non-electronic format under the Land Titles Act shall be in the form that is entitled “Transfer/Deed of Land”, “Acte de cession” or “Transfer/Deed of Land / Acte de cession” and dated September 1, 2011, as it appears on the Government of Ontario website.  O. Reg. 441/11, s. 2.

Note: On October 13, 2020, the day subsection 11 (1) of Schedule 28 to the Strong Action for Ontario Act (Budget Measures), 2012 comes into force, subsection 2 (1) of the Regulation is amended by striking out “submitted for registration under the Registry Act or for registration in a non-electronic format under the Land Titles Act”. (2) A charge submitted for registration under the Registry Act or for registration in a non-electronic format under the Land Titles Act shall be in the form that is entitled “Charge/Mortgage of Land”, “Acte de charge (hypothèque)” or “Charge/Mortgage of Land / Acte de charge (hypothèque)” and dated September 1, 2011, as it appears on the Government of Ontario website.  O. Reg. 441/11, s. 2.

(3) A discharge submitted for registration under the Registry Act or for registration in a non-electronic format under the Land Titles Act shall be in the form that is entitled “Discharge of Charge/Mortgage”, “Mainlevée de charge (hypothèque)” or “Discharge of Charge/Mortgage / Mainlevée de charge (hypothèque)” and dated September 1, 2011, as it appears on the Government of Ontario website.  O. Reg. 441/11, s. 2.

Note: On October 13, 2020, the day subsection 11 (1) of Schedule 28 to the Strong Action for Ontario Act (Budget Measures), 2012 comes into force, subsection 2 (3) of the Regulation is amended by striking out “submitted for registration under the Registry Act or for registration in a non-electronic format under the Land Titles Act”. (4) Every document submitted for registration under the Registry Act or for registration in a non-electronic format under the Land Titles Act, other than a transfer, a charge, a discharge or a document referred to in section 3, shall be in the form that is entitled “Document General”, “Document général” or “Document General / Document général” and dated September 1, 2011, as it appears on the Government of Ontario website or shall be attached to a document in that form.  O. Reg. 441/11, s. 2.

Note: On October 13, 2020, the day subsection 11 (1) of Schedule 28 to the Strong Action for Ontario Act (Budget Measures), 2012 comes into force, subsection 2 (4) of the Regulation is amended by striking out “submitted for registration under the Registry Act or for registration in a non-electronic format under the Land Titles Act”. (5) If a schedule is attached to a document that is submitted for registration under the Registry Act or for registration in a non-electronic format under the Land Titles Act and that is in the form required for a transfer, charge, discharge or in the form described in subsection (4), the schedule may be in the form that is entitled “Schedule”, “Annexe” or “Schedule / Annexe” and dated September 1, 2011, as it appears on the Government of Ontario website.  O. Reg. 441/11, s. 2.

Note: On October 13, 2020, the day subsection 11 (1) of Schedule 28 to the Strong Action for Ontario Act (Budget Measures), 2012 comes into force, subsection 2 (5) of the Regulation is revoked and the following substituted: (See: O. Reg. 560/20, s. 2 (3))

(5) If a schedule is attached to a document described in subsection (1), (2), (3) or (4), the schedule may be in the form that is entitled “Schedule”, “Annexe” or “Schedule / Annexe” and dated September 1, 2011, as it appears on the Government of Ontario website. O. Reg. 560/20, s. 2 (3).

3. The following documents need not be in a form prescribed by this Regulation if they are submitted for registration under the Land Titles Act in a non-electronic format:

1. An instrument, including a notice, caution, certificate, order or direction, that is executed by the Director, the Director of Titles, the examiner of surveys appointed under section 14 of the Land Titles Act or a land registrar.

Note: On October 13, 2020, the day subsection 11 (1) of Schedule 28 to the Strong Action for Ontario Act (Budget Measures), 2012 comes into force, paragraph 1 of section 3 of the Regulation is amended by striking out “executed by the Director, the Director of Titles” and substituting “executed by the Director of Land Registration, the Director of Titles”. (See: O. Reg. 560/20, s. 3)

2. A Crown grant.

3. An application for the first registration of land under the Land Titles Act.

4. A declaration and description under the Condominium Act.

5. A plan.  O. Reg. 17/99, s. 2; O. Reg. 441/11, s. 3.

4. If a document is attached to a document in the form described in subsection 2 (4), the latter document shall be executed by,

(a) a party to the attached document; or

(b) the party’s solicitor or agent, identified as such.  O. Reg. 17/99, s. 2; O. Reg. 441/11, s. 4.
