WASTE DISPOSAL SITES, WASTE MANAGEMENT SYSTEMS AND SEWAGE WORKS SUBJECT TO APPROVAL UNDER OR EXEMPT FROM THE ENVIRONMENTAL ASSESSMENT ACT

1. A waste disposal site, waste management system or sewage works is exempt from being the subject matter of a hearing under section 20.15 of the Environmental Protection Act if it is or forms part of an undertaking that,

Note: On February 22, 2024, the day subsection 3 (2) of Schedule 6 to the COVID-19 Economic Recovery Act, 2020 comes into force, section 1 of the Regulation is amended by adding “or project” after “undertaking” in the portion before clause (a). (See: O. Reg. 62/24, s. 1 (1))

(a) is subject to section 5 of the Environmental Assessment Act; or

Note: On February 22, 2024, the day subsection 3 (2) of Schedule 6 to the COVID-19 Economic Recovery Act, 2020 comes into force, clause 1 (a) of the Regulation is amended by striking out “section 5” and substituting “Part II.3”. (See: O. Reg. 62/24, s. 1 (2))

(b) is exempt from section 5 of the Environmental Assessment Act under section 15.1 of that Act.  O. Reg. 206/97, s. 1; O. Reg. 247/11, s. 2.
