Amending O. Reg. 225/98

(Administration and Cost Sharing)

1. (1) Subsection 2 (1) of Ontario Regulation 225/98 is amended by striking out the portion before clause (a) and substituting the following:

(1) Subject to section 5.0.1, the amount payable to Ontario by a delivery agent that is not in the Greater Toronto Area shall be equal to the sum of,

. . . . .

(2) Subsection 2 (2) of the Regulation is amended by striking out the portion before paragraph 1 and substituting the following:

(2) Subject to section 5.0.1, the amount payable to Ontario by a delivery agent within the Greater Toronto Area shall be calculated as follows:

. . . . .

2. The Regulation is amended by adding, immediately before the heading “Costs Prescribed for Cost Sharing Purposes” the following section:

5.0.1 No amount is payable by a delivery agent with respect to the following costs of assistance:

1. The special benefits set out in section 45.1 of Ontario Regulation 222/98 (General) made under the Act.

2. The increased budgetary requirements of $4 per month for each member of a benefit unit residing in an institution paid under clause 31.1 (2) (a) of Ontario Regulation 222/98 (General) made under the Act for each applicant or recipient who was a resident of an institution between July 1, 2004 and December 14, 2004.

3. Any increase in an additional daily amount determined by the Director in respect of 2004,

i. paid under clause 31.1 (2) (b) of Ontario Regulation 222/98 (General) made under the Act, and

ii. paid under clause 32 (2) (b) of Ontario Regulation 222/98 (General) made under the Act.

4. For the period commencing December 15, 2004 and ending on December 31, 2004, the increased budgetary requirement of $4 per month for each member of a benefit unit,

i. to whom clause 32 (2) (a) of Ontario Regulation 222/98 (General) made under the Act applied,

ii. to whom subsection 33.1 (2) of Ontario Regulation 222/98 (General) made under the Act applied, or

iii. to whom subsection 33.1 (3) of Ontario Regulation 222/98 (General) made under the Act applied.

5. As of November 1, 2004, the fee paid under paragraph 1.1 of subsection 44 (1) of Ontario Regulation 222/98 (General) made under the Act for periodic oculo-visual assessments for every member of the benefit unit.

3. (1) Paragraph 2 of section 5.4 of the Regulation is amended by striking out “Ontario Court (General Division)” and substituting “Superior Court of Justice”.

(2) Paragraph 8 of section 5.4 of the Regulation is amended by striking out “Ontario Court (General Division)” and substituting “Superior Court of Justice”.

4. (1) Paragraph 2 of subsection 5.8 (3) of the Regulation is amended by striking out “Ontario Court (General Division)” and substituting “Superior Court of Justice”.

(2) Paragraph 8 of subsection 5.8 (3) of the Regulation is amended by striking out “Ontario Court (General Division)” and substituting “Superior Court of Justice”.
