Amending O. Reg. 473/07

(Licences for driving instructors and driving schools)

1. (1) Paragraph 1 of subsection 8 (1) of Ontario Regulation 473/07 is revoked and the following substituted:

(2) Subsection 8 (2) of the Regulation is revoked and the following substituted:

(2) The fees under paragraphs 1 and 1.1 of subsection (1) are due when the examinations are booked and are payable even if the time booked for taking the examinations passes without the examinations being taken.

2. The Regulation is amended by adding the following section:

Fee adjustment — Consumer Price Index

8.1 (1) Beginning on September 1, 2014, and on every September 1 after that, the fee prescribed in paragraph 1 of subsection 8 (1) is the fee for the previous 12-month period adjusted by the percentage change in the Ontario Consumer Price Index between the previous two calendar years.

(2) The actual fee prescribed in paragraph 1 of subsection 8 (1) is the amount determined by the calculation described in subsection (1) rounded to the nearest quarter of a dollar.

(3) If the percentage change in the Ontario Consumer Price Index between the previous two calendar years results in a negative amount, the fee prescribed in paragraph 1 of subsection 8 (1) shall remain at the same level as the previous year.

(4) In this section, the percentage change in the Ontario Consumer Price Index between two calendar years is the percentage change in the Consumer Price Index for Ontario (All-Items) between those years as published by Statistics Canada under the authority of the Statistics Act (Canada).

Commencement

3. This Regulation comes into force on the later of September 1, 2013 and the day it is filed.
