Amending Reg. 347 of R.R.O. 1990

(GENERAL - WASTE MANAGEMENT)

1. Regulation 347 of the Revised Regulations of Ontario, 1990 is amended by adding the following section:

Waste from Covid-19 Antigen Point-of-Care Testing

29.6 (1) This section applies to a place at which COVID-19 antigen point-of-care testing is made available to any person, resulting in,

(a)  COVID-19 testing waste being generated at the place;

(b)  the place becoming a waste generation facility with respect to the COVID-19 testing waste; and

(c)  the operator of the place becoming the generator of the waste generation facility with respect to the COVID-19 testing waste.

(2) In this section,

“COVID-19 antigen point-of-care testing” means testing that employs a COVID-19 medical device authorized by the Minister of Health (Canada) for point-of-care use and that employs antigen testing technology;

“COVID-19 testing waste” means hazardous waste generated by COVID-19 antigen point-of-care testing and includes any hazardous waste from unused tests.

(3) A generator referred to in clause (1) (c) is exempt from the following provisions of this Regulation with respect to the COVID-19 testing waste generated at the waste generation facility referred to in clause (1) (b):

1.  Paragraphs 3 to 8 of section 17.2.

2.  Sections 18 and 19.

(4) A generator referred to in clause (1) (c) shall not permit the COVID-19 testing waste generated at a waste generation facility referred to in clause (1) (b) to pass from the waste generation facility except by transfer of the waste to a waste transportation system that is subject to an environmental compliance approval.

(5) A carrier is exempt from sections 20 to 24 with respect of COVID-19 testing waste that is generated at a waste generation facility referred to in clause (1) (b).

(6) A carrier is exempt from subsections 27 (3) to (6) in respect of COVID-19 testing waste that is generated at a waste generation facility referred to in clause (1) (b).

2. This Regulation comes into force on the day it is filed.
