Amending O. Reg. 285/01

(WHEN WORK DEEMED TO BE PERFORMED, EXEMPTIONS AND SPECIAL RULES)

1. Ontario Regulation 285/01 is amended by adding the following section:

Exemptions re Temporary Help Agencies

Exemptions from Part XVIII.1 of Act

10.1 (1) Part XVIII.1 of the Act does not apply in relation to an individual who is an assignment employee assigned to provide professional services, personal support services or homemaking services within the meaning of Ontario Regulation 187/22 (Home and Community Care Services) made under the Connecting Care Act, 2019 if the assignment is made under a contract between,

(a)  the individual and a local health integration network within the meaning of the Local Health System Integration Act, 2006; or

(b)  an employer of the individual and a local health integration network within the meaning of the Local Health System Integration Act, 2006.

Commencement

2. This Regulation comes into force on the later of the day section 3 of Schedule 1 to the Connecting People to Home and Community Care Act, 2020 comes into force and the day this Regulation is filed.
