Amending O. Reg. 396/22

(GRANTS FOR STUDENT NEEDS - LEGISLATIVE GRANTS FOR THE 2022-2023 SCHOOL BOARD FISCAL YEAR)

1. Section 12 of Ontario Regulation 396/22 is amended by adding the following subsection:

(3) It is a condition of the payment of a grant to a board under this Regulation that the board refrain from using any funds provided to the board under this Regulation, or any of the board’s accumulated surplus, for the purpose of,

(a)  providing a scholarship, bursary or award to pupils of the board if the scholarship, bursary or award would be provided to every pupil who is enrolled in or graduates from a school of the board; or

(b)  providing a donation to a charitable or non-profit organization.

2. Paragraphs 1 to 5 of subsection 16 (1) of the Regulation are revoked and the following substituted:

1.  The amount determined by multiplying $6,618.51 by the current fiscal year’s day school average daily enrolment of elementary school pupils, counting only pupils enrolled in junior kindergarten and kindergarten.

2.  The amount determined by multiplying $6,030.28 by the current fiscal year’s day school average daily enrolment of elementary school pupils, counting only pupils enrolled in grades 1 to 3.

3.  The amount determined by multiplying $5,025.55 by the current fiscal year’s day school average daily enrolment of elementary school pupils, counting only pupils enrolled in grades 4 to 8.

4.  The amount determined by multiplying $229.15 by the current fiscal year’s day school average daily enrolment of elementary school pupils, counting only pupils enrolled in grades 7 and 8.

5.  The amount determined by multiplying $5,938.76 by the current fiscal year’s day school average daily enrolment of secondary school pupils.

3. (1) Paragraphs 1 and 2 of subsection 17 (4) of the Regulation are revoked and the following substituted:

1.  For each qualifying sole elementary school described in Table 5, determine an amount by multiplying $60,232.73 by the applicable number or formula specified in the Table.

2.  For each qualifying sole secondary school or qualifying combined school described in Table 6, determine an amount by multiplying $60,232.73 by the applicable number or formula specified in the Table.

(2) Paragraphs 2 and 3 of subsection 17 (7) of the Regulation are revoked and the following substituted:

2.  Multiply the number determined under paragraph 1 by $1,795.16.

3.  Add $53,908.77 to the amount determined under paragraph 2.

4. Paragraphs 1 to 3 of section 19 of the Regulation are revoked and the following substituted:

1.  Multiply the current fiscal year’s day school average daily enrolment of elementary school pupils, counting only pupils enrolled in junior kindergarten, kindergarten and grades 1 to 3, by $1,066.30 to determine the enrolment-based special education amount for junior kindergarten to grade 3.

2.  Multiply the current fiscal year’s day school average daily enrolment of elementary school pupils, counting only pupils enrolled in grades 4 to 8, by $819.06 to determine the enrolment-based special education amount for grades 4 to 8.

3.  Multiply the current fiscal year’s day school average daily enrolment of secondary school pupils by $539.62 to determine the enrolment-based special education amount for secondary schools.

5. (1) Paragraph 1 of subsection 21 (1) of the Regulation is amended by striking out “$477,015.57” and substituting “$482,830.87”.

(2) Paragraphs 1 to 4 of subsection 21 (2) of the Regulation are revoked and the following substituted:

1.  $103,966.54, if the board employs one person described in subsection (3) during the fiscal year.

2.  $207,933.08, if the board employs two persons described in subsection (3) during the fiscal year.

3.  $311,899.62, if the board employs three persons described in subsection (3) during the fiscal year.

4.  $415,866.16, if the board employs four or more persons described in subsection (3) during the fiscal year.

(3) Subparagraphs 1 i to iii of subsection 21 (4) of the Regulation are revoked and the following substituted:

i.  in the case of the Conseil scolaire public du Grand Nord de l’Ontario, $3,089,580,

ii.  in the case of the District School Board Ontario North East, $3,583,913 and

iii.  in the case of the Thunder Bay Catholic District School Board, $1,977,331.

(4) Subparagraphs 2 i to iii of subsection 21 (4) of the Regulation are revoked and the following substituted:

i.  in the case of the Conseil scolaire public du Grand Nord de l’Ontario, $546,803,

ii.  in the case of the District School Board Ontario North East, $600,801, and

iii.  in the case of the Thunder Bay Catholic District School Board, $322,993.

(5) Paragraphs 1 and 2 of subsection 21 (5) of the Regulation are revoked and the following substituted:

1.  $111,341 as a base amount.

2.  The amount determined by multiplying the current fiscal year’s day school average daily enrolment of pupils by $4.16.

6. Clause 22 (2) (b) of the Regulation is amended by striking out “$28,803” and substituting “$29,524”.

7. (1) Paragraphs 1 and 2 of subsection 24 (2) of the Regulation are revoked and the following substituted:

1.  $185,942 as a base amount.

2.  The amount determined by multiplying the current fiscal year’s day school average daily enrolment of pupils by $6.13.

(2) Paragraphs 1 and 2 of subsection 24 (4) of the Regulation are revoked and the following substituted:

1.  $51,062 as a base amount.

2.  The amount determined by multiplying the current fiscal year’s day school average daily enrolment of pupils by $1.25.

8. (1) Paragraphs 1 to 3 of subsection 27 (2) of the Regulation are revoked and the following substituted:

1.  Multiply $314.28 by the number of pupils enrolled in any of grades 4 to 8 who are scheduled, on October 31 of the current fiscal year, to take instruction in French for an average of 20 or more minutes but less than 60 minutes per school day.

2.  Multiply $358.04 by the number of pupils enrolled in any of grades 4 to 8 who are scheduled, on October 31 of the current fiscal year, to take instruction in French for an average of 60 or more minutes but less than 150 minutes per school day.

3.  Multiply $400.55 by the number of pupils enrolled in junior kindergarten, kindergarten or any of grades 1 to 8 who are scheduled, on October 31 of the current fiscal year, to take instruction in French for an average of 150 or more minutes per school day.

(2) Paragraph 1 of subsection 27 (3) of the Regulation is amended by striking out “$80.70” in the portion before subparagraph i and substituting “$80.94”.

(3) Paragraph 2 of subsection 27 (3) of the Regulation is amended by striking out “$132.76” in the portion before subparagraph i and substituting “$133.15”.

(4) Paragraph 3 of subsection 27 (3) of the Regulation is amended by striking out “$106.73” in the portion before subparagraph i and substituting “$107.05”.

(5) Paragraph 4 of subsection 27 (3) of the Regulation is amended by striking out “$206.98” in the portion before subparagraph i and substituting “$207.60”.

9. Subsections 28 (2), (3) and (6) of the Regulation are amended by striking out “$4,228” wherever it appears and substituting “$4,243” in each case.

10. Paragraphs 1 to 3 of section 30 of the Regulation are revoked and the following substituted:

1.  Multiply $786.73 by the number of elementary school pupils on October 31 of the current fiscal year.

2.  Multiply $902.07 by the current fiscal year’s day school average daily enrolment of secondary school pupils.

3.  Multiply $19,534.11 by the number of elementary schools that are governed for the first time by the board in September of the current fiscal year.

11. (1) Paragraphs 2 to 9 of subsection 31 (2) of the Regulation are revoked and the following substituted:

2.  Multiply the number determined under paragraph 1 by $960.79.

3.  Multiply by $50,187.00 the number of elementary schools that are qualifying sole elementary schools.

4.  Multiply the current fiscal year’s day school average daily enrolment of secondary school pupils by the broader community factor (2011) percentage specified for the board in Column 2 of Table 11.

5.  Multiply the number determined under paragraph 4 by $418.96.

6.  Multiply by $94,253.99 the number of secondary schools that are qualifying sole secondary schools or qualifying combined schools.

7.  For each qualifying sole secondary school or qualifying combined school, determine an amount as follows:

i.  If the current fiscal year’s enrolment or the current fiscal year’s combined enrolment of the school, as the case may be, is more than zero but less than 100, the amount is $88,133.99.

ii.  If the current fiscal year’s enrolment or the current fiscal year’s combined enrolment of the school, as the case may be, is 100 or more but less than 200, the amount is $132,200.99.

iii.  If the current fiscal year’s enrolment or the current fiscal year’s combined enrolment of the school, as the case may be, is 200 or more but less than 300, the amount is $176,267.98.

iv.  If the current fiscal year’s enrolment or the current fiscal year’s combined enrolment of the school, as the case may be, is 300 or more but less than 400, the amount is $220,334.98.

v.  If the current fiscal year’s enrolment or the current fiscal year’s combined enrolment of the school, as the case may be, is 400 or more, the amount is $264,401.97.

8.  Total the amounts determined under paragraphs 2, 3, 5, 6 and 7.

9.  Add $330,996.58 to the amount determined under paragraph 8.

(2) Subsections 31 (3) and (5) of the Regulation are amended by striking out “$4,228” wherever it appears and substituting “$4,243” in each case.

12. (1) Paragraphs 1 and 2 of subsection 32 (2) of the Regulation are revoked and the following substituted:

1.  Multiply $1,468.90 by the number of elementary school pupils who, on October 31 of the current fiscal year, are scheduled to take instruction in the subject of an Indigenous language for an average of at least 20 minutes but less than 40 minutes per school day.

2.  Multiply $2,203.35 by the number of elementary school pupils who, on October 31 of the current fiscal year, are scheduled to take instruction in the subject of an Indigenous language for an average of at least 40 minutes per school day.

(2) Paragraphs 1 to 8 of subsection 32 (3) of the Regulation are amended by striking out “$1,221.03” wherever it appears and substituting “$1,224.08” in each case.

(3) Paragraphs 1 to 4 of subsection 32 (4) of the Regulation are amended by striking out “$1,221.03” wherever it appears and substituting “$1,224.08” in each case.

(4) Paragraph 4 of subsection 32 (5) of the Regulation is amended by striking out “$197.27” and substituting “$197.77”.

13. (1) Subparagraph 1 i of section 33 of the Regulation is amended by striking out the portion before the formula and the formula and substituting the following:

i.  Take the lesser of $661,004.93 and the amount determined using the following formula:

$76,442.75 + (A × $11,691.24)

(2) Subparagraph 1 ii of section 33 of the Regulation is amended by striking out the formula and substituting the following:

A × $4,122.03 + B × $5,303.90 + C × $4,299.18

(3) Subparagraph 1 iv of section 33 of the Regulation is revoked and the following substituted:

iv.  Calculate an amount using the following formula:

A – (B × $1,676.06)

in which,

“A”  is $0 if B is less than 16, $42,857.22 if B is at least 16 and less than 42, and $85,714.44 in all other cases, and

“B”  is the current fiscal year’s enrolment of the school, counting only pupils enrolled in junior kindergarten and kindergarten.

(4) Subparagraph 2 i of section 33 of the Regulation is amended by striking out the portion before the formula and the formula and substituting the following:

i.  Take the lesser of $661,004.93 and the amount determined using the following formula:

$76,442.75 + (A × $11,691.24)

(5) Subparagraph 2 ii of section 33 of the Regulation is amended by striking out the formula and substituting the following:

A × $4,122.03 + B × $5,303.90 + C × $4,299.18

(6) Subparagraph 2 iv of section 33 of the Regulation is revoked and the following substituted:

iv.  Calculate an amount using the following formula:

A – (B × $1,676.06)

in which,

“A”  is $0 if B is less than 16, $42,857.22 if B is at least 16 and less than 42, and $85,714.44 in all other cases, and

“B”  is the current fiscal year’s combined enrolment of the school, counting only pupils enrolled in junior kindergarten and kindergarten.

(7) Subparagraphs 4 i to iii of section 33 of the Regulation are revoked and the following substituted:

i.  Calculate an amount using the following formula:

$64,751.50 + (A × $23,382.49)

in which,

“A”  is the greater of one and the current fiscal year’s enrolment of the school.

ii.  Take the lesser of the amount calculated under subparagraph i and $1,233,875.86.

iii.  Subtract the amount determined using the following formula from the amount taken under subparagraph ii:

A × $4,850.01

in which,

“A”  is the current fiscal year’s enrolment of the school.

(8) Subparagraphs 5 i to iii of section 33 of the Regulation are revoked and the following substituted:

i.  Calculate an amount using the following formula:

$64,751.50 + (A × $23,382.49)

in which,

“A”  is the greater of one and the current fiscal year’s combined enrolment of the school, counting only secondary school pupils.

ii.  Take the lesser of the amount calculated under subparagraph i and $1,233,875.86.

iii.  Subtract the amount determined using the following formula from the amount taken under subparagraph ii:

A × $4,850.01

in which,

“A”  is the current fiscal year’s combined enrolment of the school, counting only secondary school pupils.

14. (1) Subparagraphs 1 i to v of subsection 34 (2) of the Regulation are revoked and the following substituted:

i.  multiply the current fiscal year’s day school average daily enrolment of pupils by $0.01834,

ii.  subtract the amount determined under subparagraph i from $337.79,

iii.  multiply the amount determined under subparagraph ii by the current fiscal year’s day school average daily enrolment of elementary school pupils,

iv.  multiply the current fiscal year’s day school average daily enrolment of pupils by $0.01834,

v.  subtract the amount determined under subparagraph iv from $337.79,

(2) Subparagraphs 2 ii to vi of subsection 34 (2) of the Regulation are revoked and the following substituted:

ii.  multiply the number determined under subparagraph i by $0.02107,

iii.  subtract the amount determined under subparagraph ii from $264.43,

iv.  multiply the amount determined under subparagraph iii by the current fiscal year’s day school average daily enrolment of elementary school pupils,

v.  multiply the number determined under subparagraph i by $0.02107,

(3) Subparagraphs 3 ii to vi of subsection 34 (2) of the Regulation are revoked and the following substituted:

(A – 150) × $1.1524

(6) Paragraph 3 of subsection 34 (5) of the Regulation is amended by striking out the formula and substituting the following:

(7) Paragraph 4 of subsection 34 (5) of the Regulation is revoked and the following substituted:

24. Section 58 of the Regulation is amended by striking out “$95.40” wherever it appears and substituting “$96.49” in each case.

25. (1) Paragraph 2 of subsection 76 (2) of the Regulation is revoked and the following substituted:

2.  Add the total of the following amounts:

i.  The product of 0.0029 and the amount determined as follows:

A.  Multiply $27.96 and the current fiscal year’s day school average daily enrolment of elementary school pupils, counting only pupils enrolled in junior kindergarten and kindergarten.

B.  Subtract the amount determined under sub-subparagraph A from the amount determined under paragraph 1 of subsection 16 (1).

ii.  The product of 0.0032 and the amount determined as follows:

A.  Multiply $27.96 and the current fiscal year’s day school average daily enrolment of elementary school pupils, counting only pupils enrolled in grades 1 to 3.

B.  Subtract the amount determined under sub-subparagraph A from the amount determined under paragraph 2 of subsection 16 (1).

iii.  The product of 0.0039 and the amount determined as follows:

A.  Multiply $27.96 and the current fiscal year’s day school average daily enrolment of elementary school pupils, counting only pupils enrolled in grades 4 to 8.

B.  Subtract the amount determined under sub-subparagraph A from the amount determined under paragraph 3 of subsection 16 (1).

iv.  The product of 0.0033 and the amount determined under paragraph 5 of subsection 16 (1).

v.  The product of 0.01 and the amount determined as follows:

A.  Take the product of the amount referred to in subsection 27 (4) and the current fiscal year’s day school average daily enrolment of elementary school pupils.

B.  Divide by the current fiscal year’s day school average daily enrolment.

C.  Add the amount determined under subsection 27 (2).

vi.  The product of 0.01 and the amount determined as follows:

A.  Take the product of the amount referred to in subsection 27 (4) and the current fiscal year’s day school average daily enrolment of secondary school pupils.

B.  Divide by the current fiscal year’s day school average daily enrolment.
