Amending O. Reg. 352/03

(DELEGATION OF POWERS, DUTIES AND RESPONSIBILITIES)

1. Sections 1 and 2 of Ontario Regulation 352/03 are revoked and the following substituted:

Delegation

1. The powers, duties and responsibilities in the following provisions are to be delegated by agreement to Plenary Americas DES LP:

1.  Clause 32 (5) (a), subclause 32 (5) (b) (i) and clause 32 (5) (c) of the Highway Traffic Act.

2.  Subsection 58 (2) of the Highway Traffic Act, but only in so far as it relates to the issuance of a temporary driving instructor licence.

3.  Sections 2.1, 3, 3.1, 23.0.1, 24, subsections 26 (4), 29 (6), (9) and (10) and section 30 of Ontario Regulation 340/94 (Drivers’ Licences) made under the Highway Traffic Act.

4.  Section 3 of Ontario Regulation 341/94 (Driver Licence Examinations) made under the Highway Traffic Act.

Effective date of delegation

2. The delegation referred to in section 1 becomes effective on September 3, 2023.

2. The Regulation is amended by adding the following French version:

Délégation

1. Les pouvoirs, fonctions et responsabilités énoncés dans les dispositions suivantes doivent être délégués par un accord de délégation à Plenary Americas DES LP :

1.  L’alinéa 32 (5) a), le sous-alinéa 32 (5) b) (i) et l’alinéa 32 (5) c) du Code de la route.

2.  Le paragraphe 58 (2) du Code de la route, dans la mesure où il se rapporte à la délivrance d’un permis temporaire de moniteur de conduite automobile.

3.  Les articles 2.1, 3, 3.1, 23.0.1 et 24, les paragraphes 26 (4), 29 (6), (9) et (10) et l’article 30 du Règlement de l’Ontario 340/94 (Permis de conduire) pris en vertu du Code de la route.

4.  L’article 3 du Règlement de l’Ontario 341/94 (Examens du permis de conduire) pris en vertu du Code de la route.

Date d’effet de la délégation

2. La délégation visée à l’article 1 prend effet le 3 septembre 2023.
