Amending Reg. 194 of R.R.O. 1990

(RULES OF CIVIL PROCEDURE)

1. (1) Paragraph 5 of subrule 4.05.1 (2) of Regulation 194 of the Revised Regulations of Ontario, 1990 is revoked.

(2) Subrule 4.05.1 (4) of the Regulation is revoked.

2. Subrule 14.03 (4.1) of the Regulation is revoked and the following substituted:

Information for Court Use

(4.1) Form 14F (Information for court use) shall be filed together with a statement of claim in Form 14A or 14B or a notice of action in Form 14C, unless the statement of claim or notice of action is filed electronically through the Civil Claims Online Portal under rule 4.05.1 or the Civil Submissions Online Portal under rule 4.05.2.

3. Subrule 14.05 (1.1) of the Regulation is amended by adding “unless the notice of application is filed electronically through the Civil Submissions Online Portal under rule 4.05.2” at the end.

4. The French version of subclause 27.03 (a) (i) of the Regulation is amended by striking out “la défense principale” and substituting “la défense à l’action principale”.

5. (1) The French version of subrule 29.05 (1) of the Regulation is amended by striking out “une défense principale” and substituting “une défense à l’action principale”.

(2) The French version of subrule 29.05 (2) of the Regulation is amended by striking out “une défense principale” in the portion before clause (a) and substituting “une défense à l’action principale”.

(3) Subrules 29.05 (3) and (4) of the Regulation are revoked and the following substituted:

Time for Statement of Defence

(3) The third party shall deliver the statement of defence within the main action within the time prescribed by rule 29.03 for the delivery of the third party defence.

Time for Reply

(4) The plaintiff shall deliver a reply, if any, to the third party’s statement of defence in the main action within 10 days after it is served on the plaintiff.

(4) The French version of subrule 29.05 (5) of the Regulation is amended by striking out “défense principale” and substituting “défense à l’action principale”.

6. Clause 62.01 (7) (c) of the Regulation is amended by striking out “signed” and substituting “issued”.

7. Subrule 63.03 (2) of the Regulation is amended by striking out “signing” and substituting “issuing”.

8. The rows for Forms 14F, 34E, 37B, 38B, 43A, 53D, 55A, 56A, 59A, 59B, 59C, 59D, 63B, 64E, 64L, 65A, 66A, 72C, 73A, 74I, 74.50, 74.51, 75.7, 75.8, 75.1B and 76B in the Table of Forms to the Regulation are amended by striking out the date in the column titled “Date of Form” and substituting in each case “January 2, 2024”.

9. (1) Paragraph 23.2 of Part II of Tariff A to the Regulation is amended by striking out “291/99” and substituting “43/05”.

(2) Paragraph 27 of Part II of Tariff A to the Regulation is revoked.

10. The following provisions of the Regulation are amended by striking out “signed” wherever it appears and substituting in each case “issued”:

1. Subclause 61.03 (2) (a) (iii).

2. Clauses 61.10 (1) (c) and (e).

3. Subrule 77.07 (6).

Commencement

11. This Regulation comes into force on the later of March 11, 2024 and the day this Regulation is filed.
