Amending O. Reg. 106/09

(DISPOSAL OF DEAD FARM ANIMALS)

1. (1) Subsection 11 (2) of Ontario Regulation 106/09 is amended by striking out the portion before clause (a) and substituting the following:

(2) An operator must not use an incinerator to incinerate dead farm animals unless the incinerator is a type in respect of which a document mentioned in subsection (2.1) has been issued, certifying that the incinerator has a secondary chamber that is capable of maintaining the gases that enter it from the primary chamber for,

. . . . .

(2) Section 11 of the Regulation is amended by adding the following subsections:

(2.1) For the purposes of subsection (2), the document must be one of the following:

1.  A verification certificate issued under the former Environmental Technology Verification (ETV) Program established by Environment Canada.

2.  A verification statement issued in accordance with the standard mentioned in subsection (2.3).

(2.2) A document mentioned in subsection (2.1) continues to apply for the purposes of subsection (2) in respect of an incinerator despite any expiry date on the document.

(2.3) For the purposes of paragraph 2 of subsection (2.1), the standard is entitled “ISO 14034:2016 Environmental management - Environmental technology verification (ETV)”, published by the International Organization for Standardization, as amended from time to time.

(3) The French version of paragraph 1 of subsection 11 (4) of the Regulation is amended by,

(a)  striking out “chambre de combustion secondaire” and substituting “chambre secondaire”; and

(b)  striking out “chambre de combustion primaire” and substituting “chambre primaire”.

(4) Paragraph 2 of subsection 11 (4) of the Regulation is revoked and the following substituted:

2.  At all times during the incineration, the temperature in the secondary chamber must be no less than the minimum temperature specified in the document mentioned in subsection (2.1) that was issued in respect of the type of incinerator.

(5) The French version of paragraph 3 of subsection 11 (4) of the Regulation is amended by striking out the portion before subparagraph i and substituting the following:

3.  Tous les gaz en provenance de la chambre primaire qui pénètrent dans la chambre secondaire y demeurent :

2. This Regulation comes into force on the later of July 1, 2024 and the day this Regulation is filed.
